1) A 26.25' square foot variance for maximum sign face area for a business unit. (code permits 55' square <br />feet, applicant request 81.25' square feet (1163.11 °). <br />NOTE: If the above variance is not granted. The following variance is requested. <br />la) A variance for 7.5' square feet is requested so present signage can remain (1163.11 °. <br />NOTE: Permit was issued for a conforming wall sign with intentions of installing the word "Plus" if a <br />variance was granted. Contractors installed a larger sign than requested, therefore none of the signage is <br />approved. Violation of Ord. 90-125, Section 1163.11(c). <br />Chairman Gomersall called all interested parties forward and reviewed the variances being requested. Mr. <br />Bayus presented Allied Lighting proposal. Mr. Bayus suggested this was primarily developed as a <br />misinterpretation by mid town neon and also their selves, they were under the impression reading through <br />the code and attending meetuigs before the board regarding Great Northern shopping center. Allied <br />Lighting has done a few signs in the center and nothing was ever set in stone until recently. Mr. <br />Gomersall asked Mr. Bayus to explain what he meant by set in stone. Mr. Bayus suggested the <br />developers were involved with submitting and working on a master plan for the past year or so. Mr. <br />Gomersall questioned what was meant by a master plan. Mr. Bayus indicated he was referring to a master <br />plan for signage in the shopping center. Building Commissioner Conway reviewed to the board members, <br />when the sign code was passed in 1991, there was a 6 month window given to the Great Northern strip <br />centers to develop their own specific signs because of the unusual setbacks. Some of the shops are <br />900'feet back from the center line of Brookpark Rd.. The developers have been working on submitting a <br />sign package to the City, and that issue is not relevant to this project. The ordinance and laws have been <br />in effect since 1991, and that is what this board has to address. Mr. Bayus indicated he understood his <br />maximum square footage is, 75'square feet and the way the sign was calculated, Mr. O'Connell blocks <br />both Avenue and Plus together. Midtown Neon in New York look at each word as being a separate object <br />as well as calculating the would plus separate which lowers the square footage, which doesn't match Mr. <br />O'Connell's and that is why this is before you tonight. Building Commissioner, Conway indicated a sign <br />permit was issued without the Plus on it which was supposed to be a certain square footage, a bigger sign <br />was installed then what they requested a permit for. The Building department granted a permit that was <br />conforming and permitted that sign with full knowledge that they would come before Board of Zoning <br />Appeals and ask for the Plus. Where they are at now is they want to add the Plus to d1e existing sign and <br />they will need a 26' foot variance relative to their frontage that is limited to 25'feet. Mr. Conway <br />indicated if the City adopts what the developers have proposed they wouid probably be compliant at <br />S 1'square feet. <br />J. Maloney motioned to grant Avenue Plus, Allied Lighting, of 26437 Great Norfllern Shopping Center <br />their request for variance (1123.12). The proposal consist of a sign package, and fllat the following <br />variance be granted a 26.25' square foot variance for maximum sign face area for a business unit. (code <br />permits 55' square feet, applicant request 81.25' square feet. Which is in violation of ord. 90-125, Section <br />(1163.11 °). The motion was seconded by, J. Konold, and unanimously approved. Variance Granted. <br />9. Geppetto's, 4967 Dover Center Rd.: <br />Request for variance (1123.12). Proposal is to hang temporary banner. <br />The following variance is requested. <br />A variance to install a 4' x 8' foot banner for 90 days. (code prohibits this type of advertising). <br />Which is in violation of Ord. 90-125, Section 1163.04 (g). <br />Chairznan Gomersall called all interested parties forward and reviewed the variances being requested. <br />Mr. Gorge, and Councilman, Miller came forward. Mr. Gomersall asked why it would take 90 days to get <br />the permanent sign put in place. Mr. Gorge indicated he was not sure why but believed his last sign took <br />4 months to be delivered. Councilman, Miller indicated that because of the setback his business will be <br />effected if he is not granted the banner. Mr. Conway asked if there would be a frame on the banner. Mr. <br />Gorge indicated there would be a frame around the bamier. <br />12
