ROLL CALL: <br />Chairinan, Maloney called the meeting to order at 7:30pm. <br />PRESENT: Chairman, J. Maloney, Board Members, J. Konold, and W. Kremzar. <br />ABSENT: Board member, T. Koberna. <br />ALSO PRESENT: Asst. Buildinb Commissioner, D. Conway, Asst. Clerk of Commissions, S. <br />Solomon and Law Director, M. Gareau. <br />II. REVIEW AND CORRECTION OF MINUTES: The Board of Zoning Appeals minutes of <br />November 2, 2000 have been submitted for review. <br />J. Maloney indicated that the board did not receive the November 2, 2000 minutes so they will be <br />voted on next inonth. <br />Chairman Maloney advised that each case would be judged on the physical situation peculiar to <br />itself, so that in no way is a judgment rendered considered to be a general policy judgment affecting <br />properties and lilce situations elsewhere. He explained that it would take three afFirmative votes to <br />approve a request. Since only three board members are present, the applicant has the choice of <br />being heard at next months meetinb. All permits and or variances granted may be picked up <br />Thursday in the building department. <br />III. BUII_,DING DEPARTMENT REQUESTS: <br />1. Rav W. Klesta5907 Barton Rd. <br />Request for variance (1123.12). The proposal consists of erection of an arbor. <br />The following variance is requested: <br />1. A 1-foot variance for side yard setbacl< (code requires 5 feet, applicant shows 4 feet). <br />Which is in violation of Ord. 90-125 section, 1135.07 A. <br />Chairinan Maloney called all interested parties forward to review the proposal. The oath was <br />administered to Mr. Klesta, the owner, who caine forward to review the proposal. Mr. Maloney <br />indicated that this arbor was ali-eady erected. Mr. Klesta replied yes it is already erected. He did <br />not know that he would need a variance for tliis, seeing that the neighboring property was also his <br />property. Mr. Maloney indicated that he had no problems with granting this variance. The board <br />members agreed. Mr. Maloney called fo'r a motion. <br />W. Kremzar motioned to grant Ray Klesta of 5907 Barton Rd. his request for variance (1123.12). <br />Which consists of an arbor. <br />1. A 1-foot variance for side yard setbacl< (code requires 5 feet, applicant shows 4 feet). <br />Which is in violation of Ord. 90-125 section, 1135.07 A. J. Konold seconded the motion and was <br />unaniinously approved. <br />2. Joseph Gercevich; 5687 Welleslev Ave. <br />Request for variance (1123.12).
