?}. <br />Chairman, Maloney called all interested parties forward to review the request. The oath was <br />administered to Mr. Chalkwater the owner. Mr. Chalkwater indicated that the variance request <br />was not.what he wanted. He believes that 7 feet from the back of the lot is not enough. He wants <br />to have the garage be 4 feet from the rear property line. He suggested that his rear neighbor had <br />his garage 3 feet from the property line, which is only three years old. The reason the inspector put <br />7-feet was a pine tree that is 4 feet from the property line. Mr. Rymarczyk commented that the <br />inspector put 7-feet because that it what Mr. Chalkwater agreed to ask for. If he would like to <br />amend the request, that is his option, but he did agree with the inspector or the inspector would not <br />have put 7-feet. Mr. Chalkwater remarked that he wanted to change the request to be 4-feet not 7- <br />feet. Mr. Koberna questioned if the applicant was asking to place the garage 4-feet from the rear <br />property line or would it be placed 6-feet from the rear lot line. This would require a 4-foot rear <br />yard variance instead of a 3-foot variance. Mr. Chalkwater indicated that he wanted the back of <br />the garage 4-feet from the rear yard line. Mr. Koberna suggested that he was concerned that the <br />neighbors might object to you.being 4 feet from the property line. Mr. Maloney indicated that he <br />was concerned about drainage. Mr. Thomas indicated that the garage would have downspouts that <br />would be connected to a drain in the driveway. Mr. Maloney questioned if the neighbors were <br />ever asked if they had objections to the garage. Mr. Chalkwater suggested that he had spoke to the <br />neighbors in the spring as his home is the only one on the street without a garage. Mr. 1Vlaloney <br />questioned if the applicant could live with being 5-feet from the rear property line. Mr. <br />Chalkwater suggested• his rear neighbor was only 3-feet from the rear properiy line. Mr. Koberna <br />questioned when the applicant wanted to start building the garage. Mr. Chalkwater suggested that <br />he would like to have it done before the weather changes. Mr. Koberna voiced a concern that <br />neighbors may object to the garage being only 4-feet from the rear property line. The request is <br />being increased by 3-feet which is a lot. He believes the neighhors should be made aware of what <br />the applicant wants before it is discussed. Mr. Maloney questioned if the applicant would like to <br />wait until next months meeting and ask for a larger variance. Nk. Chalkwater remar-ked that he <br />would wait until the next meeting. He wants the back of his garage 4-feet from the reaa- property <br />line. <br />J. Maloney motioned to table Mr. Chalkwater of 5122 Andrus Avenue his request for variance <br />(1123.12), until the November 2, 2000 meeting. As there are changes being requested new notices <br />will be mailed at no additional charge to the applicani. The motion was seconded by W. Kremzar <br />and unanimously approved. Request Tabled. 9, Haas Properties: 4858 Dover Center Rd. <br />Request for variance (1123.12).. The proposal consists of parking lot and building addition. <br />The following variances are requested: <br />A special permit to add to a non-conforming building, section (1165.02) <br />1) A 40 foot variance for building side yard setback (north) (code requires 50' applicant shows <br />10'). <br />2) A 10 foot variance for parking lot side yard setback (north) (code requires 20' applicant shows <br />10'). <br />3) A 4 foot variance for parking lot front yard setback (east) (code requires ZO' applicant shows <br />16'). <br />Which is in violation of Ord. 90-125, section 1139.07 (Table/chart) and 1165.02. <br />Chairman, Maloney called all interested parties forward to review the request. The oath was <br />administered to Mr. Porter, the architect. Mr. Porter indicated'that the home has been converted <br />into a business. The land never should have been rezoned to begin with, but as it has it is now out <br />5
