Mr. Koberna added <br />that he went to the site and saw no problems with the shed. <br />J. Konold motioned to approye David Miller of 24908 Antler Dr. his request for variance <br />(1123.12). Which consists of a shed and that the following variances be granted: <br />1) A 7 foot variance for rear yard setback (code requires 10 ft, applicant shows 3 ft) section <br />(113 5.02 (D) (4)). <br />2) A 54 square feet variance for the size of a shed (lot coverage exceeds 2%) (code permits 66 <br />sq. ft, applicant shows 120 sq. ft), section (1135.02 (D) (1)). The motion was seconded by, W. <br />Kremzar and unanimously approved. Variances Grantecl <br />2. George & Nina Mihalek; 23839 Lebern Dr. <br />Request for variance (1123.12). The proposal consists of placing a condensing unit in side yard <br />setback.. The following variance is requested: ? <br />A 2 foot side yard variance for air conditioning unit (code requires 5 ft, applicant shows 3 ft). <br />Which is in violation of ordinance 90-125 section 1135.07 A. <br />Chairman, 1Vlaloney called all interested parties forward and reviewed the request. The oath was <br />administered to Mr. Mihalek and Mrs. Mihalek, the owners whom came forward. Mr. Maloney <br />commented that he visited the site and it seems to be back from the rear of the neighbor's house <br />so noise should not be a problem for the neighbor. Mr. Mihalek commented that he had a letter <br />from the neighbor stating that she has no problem with the proposed condensing unit. No further <br />comments were made. <br />T. Koberna motioned to approve George and Nina Mihalek of 23839 Lebern Dr. their request for <br />variance (1123.12). The proposal consists of constructing a shed. <br />The following variance is requested: <br />1) A 5 foot variance for rear yard setback (code requires 10 feet, applicant shows 5 feet). Which <br />is in violation of Ord. 90-125 section, 1135.02 D 4. <br />Chairman, Maloney called all interested parties forward and reviewed the request. The oath was <br />administered to Mr. McFarland, the owner who came. forward to review the request. Mr. <br />McFarland commented that he requested a 5 foot setback instead, of 10 foot because there are no <br />residential neighbors behind his home. The junior high practice field is located behind him. Mr. <br />Maloney questioned the drainage behind the shed. Mr. McFarland replied that he was going to <br />build it up on 4 x 4's so it is not a permanent fixture, there will be no concrete slab laid. <br />W. Kremzar motioned to approve 7ames and Kimberely McFarland at 5542 Revere Dr. their <br />request for variance (1123.12). Which consists of constructing a shed and that the following <br />variance be granted: 1) A 5 foot variance for reax yard setback (code requires 10 feet, applicant <br />shows 5 feet). Which is in violation of Ord. 90-125 section, 1135.02 D 4. The motion was <br />seconded by, T. Koberna and unanimously approved. Variance Granted. <br />_ 2'
