The following variance is requested: ? <br />A 2 foot side yard variance for air conditioning unit (code requires 5 ft, applicant shows 3 ft). <br />Which is in violation of ordinance 90-125 section 1135.07 A. <br />Chairman, 1Vlaloney called all interested parties forward and reviewed the request. The oath was <br />administered to Mr. Mihalek and Mrs. Mihalek, the owners whom came forward. Mr. Maloney <br />commented that he visited the site and it seems to be back from the rear of the neighbor's house <br />so noise should not be a problem for the neighbor. Mr. Mihalek commented that he had a letter <br />from the neighbor stating that she has no problem with the proposed condensing unit. No further <br />comments were made. <br />T. The oath was <br />administered to Mr. McFarland, the owner who came. forward to review the request. Mr. <br />McFarland commented that he requested a 5 foot setback instead, of 10 foot because there are no <br />residential neighbors behind his home. The junior high practice field is located behind him. Mr. <br />Maloney questioned the drainage behind the shed. Mr. McFarland replied that he was going to <br />build it up on 4 x 4's so it is not a permanent fixture, there will be no concrete slab laid. <br />W.
