The <br />motion was seconded by T. Koberna and unanimously approved. Variances Granted. <br />8. Rainee Simons (Waaner Home Imnrovement); 24792 Tara Lvnn I3r. <br />Request for variance (1123.12). The proposal consists of a 3-season room. • <br />The following variance is requested: <br />1) A 6 foot variance for rear yard setback (code requires 50 ft, applicant shows 44 ft). <br />Which is in violation of Ord. 90-125 section, 1135.08 A. <br />Chairman, Maloney called all interested parties forward and reviewed the request. The oath was <br />administered to Mr. Wagner, with Wagner Home Improvement, and Robert Freidrich, a neighbor. <br />Mr. Wagner indicated that they propose to build a 15 x 15 foot 3-season room, which will be all <br />glass. Mr. Wagner explained that the neighborhood has very narrow lots and that is why they are <br />short the 6 feet. Mr. Maloney explained that back in 1985 the developers were cautioned that <br />there could not be any additions or enclosed patios added later. Which was because of the <br />drainage at that time. Mr. Wagrier chimed in that his company has built patios on this street <br />before. Mr. Koberna questioned on the new section or the old section. Mr. Wagner replied on <br />the new section. The board questioned the neighbor who came forward if he had any questions or <br />comments. Mr. Freidrich replied no, he just wanted to know what was going on. Mr. Gareau <br />explained that what the problem was in the Tara Lyrin subdivision was, the lots were short and the <br />board, did not know whether to give variances for the front setback or the rear setback. <br />Therefore, that is what all this discussion is about. He then commented Rainee Simons has a 40 <br />foot front setback and she has a 50 foot rear yard setback. <br />T. Koberna motioned to approve Rainee Simons of 24792 Tara Lynn Dr. her request for variance <br />(1123.12). Which consists of installation of a 3-season room and that the following variance be <br />granted: <br />1) A 6, foot variance for rear yard setback (code requires 50 ft, applicant shows 44 ft). <br />Which is in violation of Ord. 90-125 section, 1135.08 A. The motion was seconded by, J. Konold <br />and unanimously approved. Variance Granted. <br />9. Leonard & Jean Javor; 25152 Tara Lynn Dr. <br />Request for variance (1123.12). The proposal consists of installing a shed. <br />The following variances axe re,quested: ` <br />1) A 48 square foot variance for maximum square footage for a shed (code permits 72 sq. ft, <br />applicant shows 120 sq. ft), section (1135.02 (D) (1)). <br />2) An 8 foot variance for rear yard setback (code requires 10 ft, applicant shows 2 ft), section <br />(1135,02 (D) (4)). <br />3) A 3 foot variance for s'ide yard setback (code requires 5 ft, applicant shows 2 ft), section <br />(1135.02 (D) (4)). <br />NOTE: A) It is the Engineering Departments opinion that the shed must be built so as not to <br />infringe on the drainage easement. <br />B) Variance previously granted by the Board of Zoning Appeals 9/4/85 with conditions. <br />Which is in violation of Ord. 90-125 section, 1135.02 D 1, and 1135.02 D 4.
