CITY OF 1VOR'Y'H OLIVISTED <br />"TOGETHER WE CAN MAKE A IDIFFERENCE" <br />BOARD Oi' ZONING A.PPEALS <br />NIINUTES - JUNE 7, 2000 <br />I. ROLL CALL: <br />Chairman, Gomersall called the meeting to order at 7:30pm. <br />PRESENT: Chairman, R. Gomersall, Board members, J. Maloney, T. Koberna and J. <br />Konold. <br />ALSO PRESENT: Building Commissioner, D. Conway and Clerk of Commissions, D. Rote. <br />ABSENT: Board member, W. Kremzar. <br />II. REVIEW AND CORRECTION OF MINUTES: The Board of Zoning and Appeals minutes <br />of May 4, 2000 have been submitted for review. <br />J. Maloney motioned to approve the minutes of May 4, 2000 as written. The motion was <br />seconded by J. Konold and unanimously approved. <br />Chairman Gomersall advised that each case would be judged on the physical situation <br />peculiar to itself, so that in no way is a judgment rendered considered to be a general policy <br />judgment affecting properties and like situations elsewhere. He explained that it would take <br />three affirmative votes to approve a request. <br />III. BUII.,DING DEPARTMENT REQUESTS: <br />1. Stephen Musser: 25043 Lorain Rd. <br />Request for variance 1123.12. The proposal consists of converting an existing residential <br />structure into a doctor's office including parking and handicapped ramp. The following <br />variances are requested: <br />1. A 35 foot variance for building front yard setback (code requires 75 foot, applicant <br />shows 40 foot) section 1139.07, <br />2. A 5.5 foot variance for building west side yard setback (code requires 10 foot, applicant <br />shows 4.5 foot) section 1139.07, <br />3. A 37 foot variance for building setback on corner lot (code requires 50 foot, applicant <br />shows 13 foot) section 1139.08, <br />4. A 13 foot variance for parking front yard setback (code requires 20 foot, applicant <br />shows 7 foot) section 1139.07, <br />5. A 5 foot variance for parking west side yarri setback ( code requires 10 foot, applicant <br />shows 5 foot) section 1139.07, <br />6. A 19 foot variance for parking setback on corner lot (code requires 20 foot, applicant <br />shows one foot) section 1139.08, <br />Which is in violation of Ord. 90-125 section 1139.07 and 1139.08. <br />Chairman Gomersall called all interested parties forward to review the variances requested. <br />The oath was administered to Mr. Musser the owner who came forward to review the <br />request.
