ROLL CALL: <br />Vice Chairman, Maloney called the meeting to order at 7:3 Opm. <br />PRESENT: Vice Chairman, J. Maloney, Board members, T. Koberna, J. Konold and W. <br />Kremzar. <br />ABSENT: Chairman, R. Gomersall <br />AI.,SO PRESENT: Assistant Law Director, J. Dubelko, Assistant Building Commissioner, <br />T. Rymarczyk and Clerk of Commissions, D. Rote <br />II gEVEEW AND CORRECTION OF MINUTES: The Board of Zoning and Appeals <br />minutes of Apri16, 2000 have been submitted for review. <br />7. Konold motioned to approve the Board of Zoning Appeals minutes dated April 6, 2000 <br />as written. The motion was seconded by W. Kremzar and unanimously approved. <br />Vice Chairman Maloney advised that each case would be judged on the physical situation <br />peculiar to itself, sa that in no way is a judgment rendered considered to be a general <br />policy judgment affecting properties and like situations elsewhere. He explained that it <br />would take three affirmative votes to approve a request. <br />II. BUII.DING DEPARTMENT REQUESTS: <br />l. David Bastian 23015 Marion Rd. <br />Request for variance 1123.12. Proposal consists of adding a covered porch and deck to <br />the front and side of home. The following variances are requested: <br />1. A Special Permit to add to a non-conforming building, (1162.02). <br />2. A variance to enlarge a non-conforming dwelling, (1165.02 B 2). <br />3. A 20 foot variance for front setback (code requires 50', applicant shows 30') section <br />(1135.06 A). NOTE: Present front setback is 40' in lieu of 50'. <br />4. A 14 foot variance for side yard setback (code requires 25', applicant shows 11') <br />section (1135.06 B). NOTE: Present side yard setback is 15 feet in lieu of 25'. <br />Which is in violation of Ord. 90-125 sections, (1135.06 A), (1136.06 B) and (1165.02 B <br />2). <br />Vice Chairman Maloney called all interested parties forward and reviewed the variances <br />requested. The oath was administered to Mr. & Mrs. Bastain, the homeowners who came <br />forward to review their request. Mr. Bastain indicated that they would like to build a new <br />front porch which, would wrap around the side of the house to the side door. Mr. <br />Koberna indicated that he thought the porch would be an asset to the home. No further <br />comments were made. <br />J. Konold motioned to grant David Bastian of 23015 Marion Rd their request for variance <br />(1123.12), which consists of adding a covered porch and deck to the front and side of <br />home and that the following variances be granted: <br />1. A Special Permit to add to a non-confornung building, (1162.02). <br />2. A variance to enlarge a non-conforming dwelling, (1165.02 B Z).
