Mr. Kremzar questioned if the distance could be changed. Mr. Banak indicated that he has no
problem with the 5-foot off the sideline of the property, but if the shed comes out any farther it
would be placed in the middle of the yard. Mr. Banak indicated he is trying to get the shed
underneath the tree. Mr. Gomersall indicated the Board does not accept 2 feet because the shed
would be harder to maintain. In addition to that, he questioned what Mr. Banak was proposing for
water runoff. Mr. Banak indicated he wasn't concerned with the water run off as he was going to
grow a garden all the way around the shed. Mr. Gomersall indicated the Board would accept the 5
feet, but not the 2 feet. Mr. Banak indicated he would accept the 5 feet instead of the 2 feet.
J. Maloney motioned to grant 1Vlark Banak of 3386 E. Oxford Oval, as amended and agreed, his
request for variance 1123.12, which consists of a shed and that the following variances are granted:
a five foot variance for rear setback 1135.02(d)(4) and a 55 foot variance for eYCeeding allowable
footage (1135.02(d)(1). Wluch is in violation of Ord. 90-125 sections 1135.02(d)(4) and
1135.02(d)(1). The motion was seconded by J. IConold and una.iiimously approved. Variance
Granted.
3. Gil & Betty Jackson; 27051 Newton Circle
Request for variance 1123.12. The proposal consists of adding onto an eYisting attached garage.
_,- The following variance is requested:
A 13-foot. variance for rear yard setback (code pernuts 50 foot, applicant shows 37 foot).
Which is in violation of Ord. 90-125 section 1135.08 A.
Chairman Gomersall called all interested parties forward to review the request. Gil Jackson,
applicant, and Dick Bowman and Ga.ble Horvath, neighbors, came forward to review the request.
Mr. Horvath has no problems with the variance. Mr. Gomersall questioned why the applicant
wanted such a big garage. Mr. Jackson indicated a bigger garage is needed to restore automobiles.
Mr. Kremzar questioned the firewall. Mr. Jackson indicated there would be a firewall on the south
side of proposed addition. Mr. Gomersall indicated the proposed addition is not 15 feet from the
house, so the firewall must extend down the whole southern wall. Mr. Gomersall questioned if there
were any questions from the board or audience members. No further comments were made.
J. Maloney motioned to grant Gil & Betty Jackson of 27051 Newton Circle their request for
variance 1123.12, as amended and agreed, which consists of adding onto an existing attached
garage and that the following variance be granted: A 13-foot variance for rear yard setback (code
permits 50 foot, applicant shows 37 foot). Which is in violation of Ord. 90-125 section 1135.08 A.
In addition, there will be a firewall extending from the present garage alongside the house to the rear
of the garage. The motion was secorided by W. Kremzar and unanimously approved. Variance
Granted.
4. Michael Piskunoff; 6132 Bellevue Dr.
Request for variance 1123.12. The proposal consists of a family room addition to existing dwelling.
The following variance is requested:
A 6.5 foot variance for rear yard setback (code requires 50 foot, applicant shows 43.5 foot). Which
is in violation of Ord. 90-125 section 1135.08A.
Chairman Gomersall called all interested parties forward to review the request.
Mr. Piskunoff came forward to review the request. Mr. Gomersall questioned if there were any
questions from the Board or audience members. No further comments were made.
J. Konold motioned to grant Michael Piskunoff of 6132 Bellevue Dr. his request for variance
1123.12, which consists of a family room addition to existing dwelling and that the following
variance be granted: A 6.5 foot variance for rear yard setback (code requires 50 foot, applicant
shows 43.5 foot). Which is in violation of Ord. 90-125 section 1135.08A. The motion was
seconded by W. Kremzar and unanunously approved. Variance Granted.
