<br />Mr. Kremzar questioned if the distance could be changed. Mr. Banak indicated that he has no <br />problem with the 5-foot off the sideline of the property, but if the shed comes out any farther it <br />would be placed in the middle of the yard. Mr. Banak indicated he is trying to get the shed <br />underneath the tree. Mr. Gomersall indicated the Board does not accept 2 feet because the shed <br />would be harder to maintain. In addition to that, he questioned what Mr. Banak was proposing for <br />water runoff. Mr. Banak indicated he wasn't concerned with the water run off as he was going to <br />grow a garden all the way around the shed. Mr. Gomersall indicated the Board would accept the 5 <br />feet, but not the 2 feet. Mr. Banak indicated he would accept the 5 feet instead of the 2 feet. <br />J. Maloney motioned to grant 1Vlark Banak of 3386 E. Oxford Oval, as amended and agreed, his <br />request for variance 1123.12, which consists of a shed and that the following variances are granted: <br />a five foot variance for rear setback 1135.02(d)(4) and a 55 foot variance for eYCeeding allowable <br />footage (1135.02(d)(1). Wluch is in violation of Ord. 90-125 sections 1135.02(d)(4) and <br />1135.02(d)(1). The motion was seconded by J. IConold and una.iiimously approved. Variance <br />Granted. <br />3. Gil & Betty Jackson; 27051 Newton Circle <br />Request for variance 1123.12. The proposal consists of adding onto an eYisting attached garage. <br />_,- The following variance is requested: <br />A 13-foot. variance for rear yard setback (code pernuts 50 foot, applicant shows 37 foot). <br />Which is in violation of Ord. 90-125 section 1135.08 A. <br />Chairman Gomersall called all interested parties forward to review the request. Gil Jackson, <br />applicant, and Dick Bowman and Ga.ble Horvath, neighbors, came forward to review the request. <br />Mr. Horvath has no problems with the variance. Mr. Gomersall questioned why the applicant <br />wanted such a big garage. Mr. Jackson indicated a bigger garage is needed to restore automobiles. <br />Mr. Kremzar questioned the firewall. Mr. Jackson indicated there would be a firewall on the south <br />side of proposed addition. Mr. Gomersall indicated the proposed addition is not 15 feet from the <br />house, so the firewall must extend down the whole southern wall. Mr. Gomersall questioned if there <br />were any questions from the board or audience members. No further comments were made. <br />J.
