Mr. Gomersall indicated that any of the properties could be <br />torn down and it would not come to the Board of Zoning Appeals, it would go to another Board. <br />Mr. Konold indicated that Mr. Trapp is looking the future of what might happen and that can not be <br />done in a growing city. Mr. Trapp indicated the Board is looking into the future by the applicarit <br />proposing to build a house. Mr. Hoffinan indicated the applicant would not go through the Boards <br />if nothing were going to be done. Mr. Trapp questioned if what the Board was telling him is there <br />is nothing he can do about the applicant building a house. Mr. Gomersall indicated "no", it's the <br />applicant's property, they are paying taxes on it, and therefore, are allowed to build a house on it. <br />Mr. Trapp then questioned information from the notices. The Clerk and the Board clarified the <br />information as much as possible. Mr. Trapp indicated he is at the meeting to eYpress his concerns <br />and that the Board is telling him he can't do that. Mr. Gomersall indicated that Mr. Trapps <br />concerns should relate to what is before the Board and that is building a house, not rezoning or a <br />driveway. Mr. Trapp then indicated he would not like the house built. Mr. Konold questioned what <br />right he has to stop a person from putting a house on property that they own. Mr. Trapp indicated <br />he is only expressing his concerns. Mr. Gomersall indicated Rosie Jenne could do as she wishes <br />with her own property. Mr. Maloney indicated Ms. Jenne has a year to build a house on the <br />property. Mr. Trapp questioned what would happen if the house wasn't built in a year. Mr. <br />Gomersall indicated the appiicant would have to reapply. Mr. Juhn indicated he was at the meeting <br />on behalf of his mother, whom is a neighbor. He indicated that she feels if you stray from the codes <br />that are presently in affect, that it will affect future property evaluations in that area. Mr. <br />Gomersall questioned Mr. Juhn's mother's name. Mr. Juhn indicated it was Alice and he was there <br />to make sure the Board had received the letter. Mr. Gomersall indicated that the applicant is entitled <br />to build on it, and it is only a 40-foot lot. Mr. Juhn indicated he is there to address that the lot was <br />deemed too small to build a house, so if the house is put up, it will cramp the surrounding houses. <br />Mr. Gomersall indicated that this house lot size is no different than the surrounding houses. Mr. <br />June indicated that his mother is against it. Mr. Gomersall indicated that people could not be <br />deprived of building on their own property. Mr. Kremzar questioned the size of the lot. Mr. <br />Gomersall indicated the lots are 55-feet wide. <br />W. Kremzar motioned to grant Rosie Jenne of 5179 Porter Rd. the Request for variance <br />1123.12, which consists of new single family dwelling and that the-following variances be <br />granted, as requested: <br />l. An 18-foot 8-inch variance for rear yard setback. (Code requires 50 feet, applicant <br />shows 31 foot 4 inches), (1135.08 A). <br />2. An 84 square foot variance for livable first floor area (code requires 850 square feet, applicant <br />shows 766 square feet), (1135.03 b). <br />Which is in violation of Ord. 90-125 section 1135.08(A) and 1135.03(b). _The motion was seconded <br />by J. Maloney and unanimously approved. Variance Granted. <br />8. Frank Richard, Jr.; 5582 Quail Run <br />Request for variance 1123.12. The proposal consists of a sunroom addition. <br />The following variance is requested: <br />A 6 foot 4 inch variance for rear yard setback (code requires 50 feet, applicant shows 43 foot 4 <br />inches). Which is in violation of Ord. 90-125 section 1135.08(A). <br />Chairman Gomersall called all interested parties forward to review the request. <br />Frank Richard, the applicant and Larry Wagner of Wagner Home Improvement came forward to <br />review the request. Mr. Gomersall questioned if there were any questions from the Board or <br />audience members. No further comments were made. <br />J.
