Mr. <br />Rymarczyk indicated adding that the existing garage must be demolished starting 30 days of the new <br />proposed garage being constructed. <br />J. Konold motioned to grant Lee Koch of 5947 McKenzie his request for variance 1123.12, which <br />consists of a detached garage and that the following variances be granted: <br />1.)A 450 square foot variance for total floor area of detached garage (code allows 750 square feet, <br />applicant shows 1200 square feet), (1135.02 c 1). <br />2.)A 1 foot Z 3/4 inch variance for total height (code requires 15 foot, applicant shows 16 foot 2 3/4 <br />inches), (1135.02 c 1). <br />3.)A variance to not have a concrete or bituminous concrete driveway (code requires concrete or - <br />paved surface, applicant shows none), (1161.11). <br />Which is in violation of Ord. 90-125 sections 1135.02(c)(1) and 1161.11. In addition, the existing <br />garage would be demolished starting 30 day, s of the new proposed garage being constructed and that <br />a paved driveway be put in within a year after the garage has been constructed. The motion was <br />seconded by W. Kremzar and unanimously approved. Variances Granted. <br />7. Rosie Jenne; 5179 Porter Rd. <br />Request for variance 1123.12. The proposal consists of new single family dwelling <br />The following variances are requested: <br />l. An 18-foot 8-inch variance for rear yard setback. (Code requires 50 feet, applicant shows 31 <br />foot 4 uiches), (1135.08 A). <br />2. An 84 square foot variance for livable first floor area (code requires 850 square feet, applicant <br />shows 766 square feet), (1135.03 b). <br />Which is ul violation of Ord. 90-125 section 1135.08(A) and 1135.03(b). <br />Chairman Gomersall called all interested parties forward to review the request. <br />Jolul Hoffinan, representing Rosie Jenne, and neighbors Bob Trapp; Ken Felleisen, Fred Hatton and <br />Marty Juhn came forward to review the request. Mr. Hoffinan indicated the proposal is to build a <br />new home and the variances are needed since the lot is small. Mr. Felleisen questioned if the <br />property would be rental. Mr. Hoffinan replied that the house would be sold; it would not be rented. <br />Mr. Gomersall questioned who Rosie Jenne was. Mr. Hoffinan indicated she was owner of a few <br />properties off of Lorain in North Olmsted. Mr. Trapp questioned who the existing owner was and <br />who would be the new owner. Mr. Hoffinan indicated that once the house is built it would be sold. <br />Mr. Trapp produced a parcel map of all the abutting properties and asked for clarification of what <br />certain lines represented. Mr. Rymarczyk indicated Mr. Trapp needed to speak with the <br />Engineering Department. Mr. Trapp is concerned since the property, which is presently vacant, is <br />directly across the street from his property. Mr. Trapp indicated the property with the car wash is <br />landlocked and that over the past three years there have been numerous attempts to gain access by <br />going through other properties. In recent years there had been some mention of rezoning the <br />property, as well. Mr. Trapp questioned what would happen if the applicant chose not to build a <br />house and the property was sold and a driveway to a commercial property is put in. Mr. Trapp <br />questioned the intentions of an owner next door to the post office. Mr. Gomersall questioned if the <br />owner could put in driveway. Mr. Rymarczyk indicated there are no plans for it to be commercial <br />and have a driveway put in. Mr. Trapp questioned if the car wash and the beverage store were <br />commercial. Mr. Rymarczyk indicated that since the businesses are located on Lorain Road, they <br />would most likely be commercial. Mr. Gomersall indicated anything could happen and the Board <br />can not speculate what is to happen in the future. Mr. Konold indicated that Mr. Trapp could not <br />stop rezoning if it were to happen. Mr. Trapp indicated he is only making his concerns known. Mr. <br />Gomersall indicated the applicants would be asking to build a house if they were planning on <br />putting in a driveway. The property would need to be rezoned. Mr. Maloney indicated that the <br />Board could only address what is before them now in this proposal, which would be a house. Mr. <br />Trapp questioned what he could do if the Board approves the building of the house. Mr. Gomersall
