Mr. Gomersall commented about the tivater <br />retention and understood it was not a problem. Mr. Solt indicated he was correct, the underwater retention <br />is taken care o£ Mr. Gomersall questioned if the City Forester had spoken with the Church or the <br />neighbors. Mr. Solt indicated that the Forester had not spoken with any of them. He also indicated that the <br />Forester was supposed to come out and take a look at the landscaping and contact the Church concerning <br />the trees that are near the north side. He commented that no trees would be removed in the area. Mr. <br />Szaniszlo has been neighbors with the Church for more than 25 years and had a common understanding <br />with tha church iu regards to the tree line as a barrier. He indicated the tree barrier would never be <br />infringed upon because it is a form of a natural barrier from their parking lot to the back of their yards. <br />Mr. Gomersall commented that he was joing to read the note from the Forester to the Planriing <br />Commission. Mr. Gomersall then indicated that the issue of the landscaping is between the Church and the <br />Neighbors and not this Board. From this Boards point of view, the landscaping looks nice. Mr. Szaniszlo <br />indicated that he wasn't totally aware of what was to be discussed at the Board of Zoning Appeals meeting <br />and was only going by what was on the Notice he received. Mrs. Szaniszlo questioned what the Church <br />was violating. Mr. Gomersall commented that the reason the Church was before the board was to request a <br />special pernut; because they are attaching to a non-conforming building. Mr. Gareau indicated that a <br />church is a pernutted use in a single-family residential area, provided they get a special permit. Mr. 7oslyn <br />commented about his concern for the thin landscaping do-vvn at the north end nearest his property. Mr. <br />Gomersall indicated he could attend the Board of Zoning and Development meeting and raise those issues F <br />there. No further comments were made. <br />W. Kremzar motioned to grant North Olmsted United Methodist Church of 4600 Dover Center Rd. their <br />request for a special permit 1123.11. Which consists of a 2450-sq. ft. addition to the rear of the eYisting <br />church and a special pernut to add to a non-conforming building. Which is in violation of Ord. 90-125 <br />section, (1165.02 B1). The motion was seconded by J. Konold and unatvmously approved. Variance <br />Granted. <br />4. Dr. Clark Peck: 30033 Lorain Rd. <br />Request far variance (1123.12). Proposal consists of using existing structure as a place of business. The <br />following variances are required: <br />l. An 8 foot variance for-width of drive, (code requires 18ft, applicant shows lOft), (1161.10). <br />2. A 3 car parking variance for number of cars parking,(code requires 5, applicant shows 2).(1161.05 <br />O). <br />3. A 1 foot variance for side yard setback, (code requires lOft, applicant shows 9ft), (1139.07). <br />Wluch is in violation of Ord. 90-125 sections, (1161.10), (1161.05 O) and (1139.07). <br />Mr. Gomersall called all interested parties forward to review the variances requested. Doctor Clark Peck <br />and Paul Hilts, the Architect, came forward to review the request. Dr. Peck indicated in a drawing that he <br />presently has three parking spaces, and doesn't need more. Mr. Gomersall questioned whether Dr. Peck <br />had three cemented parking spaces. Dr. Peck replied "yes". He indicated that the owner is using the one <br />parking space for storage. Dr. Peck indicated that since CVS has bought the property, he had to find <br />another facility for the practice. He indicated his property next door has parking and since he won't be <br />parking where he will be working, he only needs three parking spaces. Dr. Peck only works three days a <br />week from 9:30am-5pm, and only one person is scheduled every half-hour. Dr. Peck indicated he is <br />retiring in two year. Mr. Conway suggested ma.king the variance a condition for Dr. Peck's use only. Dr. <br />Peck indicated he understands. Mr. Gomersall inquired if the Board or audience had any concerns or <br />questions. No further comments were made. <br />J.
