Mr. Dubelko commented that the board needs to act on what is before <br />them tonight and make a recommendation to the Board of Zoning Appeals. Mr. Tallon inquired <br />if any audience members had any comments or questions on this proposal. Mr. Peter Harwood, <br />an attorney for Tony Roma's, came forward to comment that the owner would like to have the <br />parking lot made a single parking lot in tlie front. His client is concerned about the impact this <br />will have on his patio business because there will be a wall and construction there. He is also <br />concerned about the signage exposure, currently signage is on the east facing wall, this proposed. <br />building will block that signage, there is some talk of moving the sign farther north on the wall <br />of his clients restaurant which would still block it from view by the bulk of the traffic coming <br />from'the east and the shopping area. It might be able to be seen by motorists on Brookpark <br />Road. His client is a small company and they are not wishing to fight with Developers <br />Diversified but they would like the commission to consider the possibility of addressing the <br />location of the building farther north which would leave the exposure and a part of the patio <br />available for freer use. Mr. Harwood then commented that Mr: Hough and his client have <br />spoken about some of these issues and he gathers that there is no probability that will be worked <br />out but he wanted to present these thoughts to the Planning Commission and thanked them £or <br />their time. Mr. Tallon questioned if Mr. Harwood was saying that they want the two parking lots <br />to connect and open them up. Mr. Harwood replied yes, there is a curb in there that could be <br />taken out. Mr. Tallon agreed. Mrs. O'Rourke commented that four handicapped spaces would <br />need to be eliminated for the drive area. Mr. Tallon questi.oned what the little triangle piece is <br />that goes between the two .properties. Mr. Hough commented that there is grass there now but <br />the piece can be taken out entirely. R. Tallon questioned if the islands on the end are landscaped. <br />Mr. Hough commented that is just grass area. Mr. Tallon commented that if they had head in <br />parking to the building and then make the isle way behind the head in parking all the way across. <br />These are not part of the major strip where people will be walking all of the time, this is <br />restaurant parking and then whatever this building will be which would result in easy access for <br />handicap and so forth. <br />R. Tallon znotioned to approve Developers Diversified their new building (Next to Tony Roma's) <br />permanent parcel 235-27-009, a new 5,400 square foot building with parking and landscaping. <br />The proposal will go to the Architectural Review Board for their input on the landscaping and <br />building itself. There will be four (4) handicapped parking spaces removed and replaced with <br />head in parking for Tony Roma's and the new building. The center island between the two <br />parcels will be removed and relocated to form a connecting driveway through Tony Roma's <br />parking lot and the new parking lot. The board recommends the Board of Zoning Appeals grant <br />the dumpster area variance and the 2% (percent) lot coverage variance needed. The motion was <br />seconded by C. Allan and unanimously approved. Motion Carried. R. Tallon motioned to recommend the Board of Zoning Appeals look favorably at the 4.5 car <br />ratio that the developer will submit. If not the Planning Commission recommends that the <br />request for 400 parking space variances be granted. The motion was seconded by T. Hreha and <br />unanimously approved. Motion Carried. Note: In the framing of the motion Mr. Tallon <br />indicated that the proposal would return to the Planning Commission once they have gone before <br />Board of Zoning Appeals. <br />4
