? <br />.f <br />J <br />quite a few buildings that are E.F.I.S. and found that he now looks for E.F.I.S. buildings since the <br />last meeting. There are more E.F.I.S. buildings then he thought there was in the area; even most <br />of Jacob's field is E.F.I.S. He understands the concerns of continuing the same look but he does <br />not think an additional 8 feet of brick will benefit the building. Mr. Asseff remarked that he <br />agreed with Mr. Allan and Mr. Hreha. Mr. Spalding indicated that he agreed with Mr. Tallon <br />about the brick height. He believes there should be a better blending of the two buildings. On the <br />other hand, if the Architectural Review Board accepts this then we should accept the plan. He <br />would like the Architectural Review Board to review the building before it is approved. Mr. <br />Allan indicated that the Architectural Review Board is in acceptance with the plan as they have <br />signed off on the plans that have been submitted. Mr. Tallon did not believe that the Architectural <br />Review Board was in agreement as they asked for all brick but did not get it. They just accepted <br />this as an alternative. He is not saying that this submittal is bad he is just saying that to have the <br />entire building brick would be better. Mr. Allan did not agree. Mr. Asseff thought that the <br />additional 8 feet of masonry would not be noticeable and indicated that the Architectural Review <br />Board agreed that the Dillard's building should not blend but have its own identity. Mr. Koeth <br />asked to see a drawing that would show the skyline view. Mx. Rinker showed a plan that showed <br />the mall addition and the Dillard's building together. He believed that the 8foot difference of brick <br />was more of a personal like or dislike then an architectural one. There will be heavy landscaping <br />around the building and -the overall theme is to make the Dillard's building standout. Mrs. <br />O'Rourke indicated that the trees in the picture appear to be about 20 feet tall and questioned if <br />the trees that will be planted would be 20 feet high: Mr. Loesch indicated that the new trees <br />would match the height of the exiting trees. The owners would like to make the additions look as <br />if they have always been a part of the mall. Mr. Barker a resident questioned if the brick could be <br />slowly stepped down to meet the mall addition. Mr. Rinker indicated that they felt the current <br />plans worked the best. Councilman McKay indicated that he was happy to get the 16 feet of <br />brick. At the last Plannina Commission meeting it was suggested that most of Beachwood Mall <br />was E.F.I.S., so he went to the Beachwood Mall to observe their buildings. He noticed a new <br />building being erected which was all marble and it was quite an eye catcher. Mr. Philp Paun a <br />resident questioned if Dillard's had the money to bring the brick height to the same level as the <br />mall addition. Mr. Rinker indicated that it was not. a question of money. Dillard's wants their <br />own identity. Mr. Mihai Paun a resident suggested having the brick height the same level would <br />still allow Dillard's to stand out and would not take away from either buildings appearance. If it <br />is the same as the addition height, it will blend in better. Mr. Dubelko indicated he would like to <br />review the board's responsibility for the members that were not present at the last meeting. When <br />a proposal comes before the Planning Commission there is an assumption that it meets the code. <br />This does meet the code, especially once the variances were granted by the Board of Zoning <br />Appeals board. At that point, the Planning Commission has an obligation in framing of its motion <br />to pass it on to the Board of Zoning and Development and Council. To recommend favorably on <br />it with any changes the Planning Commission determines are necessary, due to adverse impacts <br />that this project may cause in certain areas. Relative to this proposal, it is a subject of ethics as to <br />whether or not this proposal by the developer will have an adverse impact on esthetics upon <br />neighboring properties in this zoning district. "That is the law." The board's authority is very <br />limited in this area and it is essentially the developer's choice as to how to design their building, as <br />long as it is not causing an adverse impact on neighboring properties. <br />3
