Mr. Kurlander indicated that there could be no obstructions of that line of <br />site, including leaves, trees, etc. He indicated that the use of tall buildings takes <br />the site of the antenna out of street level. Mr. Koeth reviewed that the antenna <br />needs to be unobstructed in order to collect data. Mr. Kurlander indicated that is <br />correct. There must be an unobstructed line of site between the collection point <br />and the customer building locations. Mr. Koeth asked Mr. Kurlander to review <br />the collection sites. Mr. Kurlander indicated that the collection site contains <br />antenna's that are transceivers, which transmit and receive. He indicated that what <br />happens at the collection point is that the antenna transmits and receives signals to <br />and from the customer sites that ultimately are fed into the land based telephone <br />system at the Westbury location. Mr. Kurlander indicated that the customer <br />facilities would be purely wireless, so there is fewer infrastructures and can <br />operate at a higher capacity. NIr. Tallon questioned Mr. Dubelko on what would <br />preclude Teligent from placing a 25-foot antenna because of an obstruction. Mr. <br />Dubelko indicated that by the way the Ordinance is written, it is already. <br />prevented. Mr. Tallon questioned if that is because it is included in the ordinance, <br />but if the Board were to exempt it what would happen then. Mr. Dubelko <br />indicated that the Board could exempt out this kind of technology, and it can <br />indicate all the conditions. If it is exempted then it falls into the broader <br />• regulation for the towers. Mr. Tallon questioned if they should just exempt the <br />applicants from certain regulations. Mr. Dubelko suggested exempting certain <br />technology if it is just servicing the business. He suggested exempting out item <br />by item what is not wanted. Mr. Kurlander indicated that the building owners are <br />concerned with the aesthetics and placement of antennas as much as the Board. <br />Mr. Tallon indicated that it has to do with marketability, as well. He indicated that <br />the Board is just trying to protect the City to eliminate it becoming a jungle. He is <br />concerned that if once it were approved, would it become a Pandora's box. Mr. <br />Spalding questioned where the collection point would be located. Mr. Kurlander <br />replied "the Westbury." He indicated that the only exterior equipment would be <br />the antennas and coaxial cable that would lead to the equipment located inside the <br />building. Mr. Tallon questioned whether a special variance was used previously <br />witli the first antenna going up. Mr. Dubelko indicated it was most likely a like <br />and similar use permit. Mr. Tallon indicated the controversy of moving into a <br />residential area. Mr. Dubelko indicated that the building is mixed use. Mr. <br />Tallon questioned if the Ordinance needs to be readjusted for this proposal. Mr. <br />Dubelko indicated the request should be denied because this particular use is <br />already provided for in the code. Mr. Kurlander indicated it was at the Building <br />Commissioner request that the applicants come before the Boards. He suggested <br />that it would be in the City's best interest to expedite a proposal such as theirs in <br />the future to not have to appear before Board of Zoning Appeals at each proposal. <br />Mr. Tallon indicated that the Board would recommend that Council look at the <br />Ordinance and to exempt out that section of the Ordinance. One of the audience <br />members came forward questioning what kind of antenna would be used and how <br />high would it be located. Mr. Kurlander indicated it would be a single 24 inch <br />antenna and be no higher than allowing for unobstructed line of site to the <br />Westbury. Mr. Tallon questioned if Mr. Kurlander was referring to the antenna as <br />a dish. Mr. Kurlander indicated that is correct.
