Spalding; S. Asseff, C. Allan <br />and T. Hreha. <br />ALSO PRESENT: Assistant Law Director, J. Dubelko, Building Commissioner, D. Conway and <br />Clerk of Commissions, D. Rote. <br />ABSENT: Vice-Chairman, R. Koeth. <br />II. REVIEW AND CORRECTION OF MINUTES: No item. <br />III. BUILDING DEPARTMENT REQUESTS: No item. <br />IV. NEW DEVELOPMENTS AND SUBDIVISIONS: No item. <br />V. COMMUNICATIONS: <br />l. Ordinance No. 2000-12 <br />An ordinance creating new and revised chapter 1163 of the Zoning Code of the City of North <br />Olmsted, entitled "SIGNS" as amended. <br />Mr. Tallon indicated that he would like to address 1163.19-subsection (C) of "Illuminated signs." He <br />would like to recommend to Council that the wording colored neon or other similar fluorescent gas, <br />be stricken from the ordinance. Under 1163.27 subsection (A) "Wall Signs" The words flat of solid <br />face construction be stricken from the ordinance. The new reading will read; as regulated by this <br />ordinance, shall mean all shall mean all signs which are attached to the exterior front, rear, or side <br />wall of any building or other structure, or are painted directly on the wall or other part of the <br />structure. Mr. Hreha commented that under 1163.10 subsection. (A) "Non-conforming signs" the <br />wording is either more than $1,000.00, or exceeds be stricken from the ordinance. He would like <br />subsection (A) to read: - No non-confornung sign or part thereof shall be altered, modified, or <br />changed in any manner whatsoever in any process of reconstruction, repair, or restoration, that <br />exceeds 25% of the sign's replacement value, unless the entire sign shall be brought into compliance <br />with all of the provisions of this Chapter, and all other applicable City Laws. Under subsection (B) <br />last week there was concern about having to change a sign just because an owner changes. He <br />doesn't agree with subsection (B). Mr. Asseff questioned Mr. Dubelko if the term occupancy have <br />any legal significance. He suggested subsection (B) read Every non-confornung sign located upon a <br />property which either undergoes a change of use or if building occupancy changes, shall be brought <br />into compliance with all of the provisions of this Chapter, and all other applicable City Laws.
