V. CONIlVlUNICATIONS: <br />l. The Planning Commission needs to review the following ordinance: <br />Ordinance 2000-13, "An ordinance providing for the amendment of the zone map of the City of <br />North Olmsted in order to supplementary zone the hereinafter described parcels of real property, <br />so as to include them within the Wireless Telecommunication Facilities Overlay District <br />("WTFO") of the City of North Olmsted as amended. " <br />Mr. Tallon suggested that the proposal was to include the Great Northern Shopping Center to the <br />Wireless Telecommunication Facilities Overlay District. He asked Mr. Dubelko to review the <br />Telecommunication overlay setbacks and requirements. Mr. Dubelko commented that in section <br />1151.05 C it states that all wireless telecommunication towers shall be located a distance of at <br />least 300 feet from the property lines of residentially zoned or use properties. The towers have to <br />comply with the setback requirements for that district for any structure. In addition if they are <br />close too residential it can be no closer than 300 feet from the property line. Mr. Tallon = <br />questioned. if Mr. Dubelko was suggesting the towers would be treated as structures. Mr. <br />Dubelko replied "yes," the intent of the ordinance is to regulate the location of towers. Ordinance <br />2000-13 is just adding another area to the Wireless Telecommunication Facilities overlay district. <br />It was recommended by our telecommunication expert Todd Hunt, from the law firm of Walter & <br />Haverfield. Presently there is land on the west end of town that is located in the overlay district <br />as well as I-480, if the state allows the towers. The expert felt after reviewing the federal law <br />(Telecoinmunications act) which passed in 1996, that the City should have some private property <br />added to the Wireless Communication Facilities Overlay District. He felt that it was not sufficient <br />to only have the private industrial land on the West Side of North Olmsted. Mr. Dubelko <br />indicated that the expert felt including an area in the center of town would assist the City in any <br />future challenge regarding the amount of land within the Wireless Communication Facilities <br />Overlay District. Mr. Tallon questioned if there was a limit to the number of poles that could be <br />erected. Mrs. O'Rourke commented that the towers would have to be 1/2 mile apart. Mr. <br />Dubelko reviewed that "1151.OS A" stated a minimum of '/2 mile distance between towers. He <br />noted that if there is a need to have a tower within this area and it cannot be placed it puts the <br />City in an awkward situation legally. It is also important for federal purposes to note that towers <br />can only go up in the overlay districts if the landowner allows it on their site. NIr. Tallon <br />suggested that only one tower could fit on the Great Northern site as the required setbacks and <br />square-footage of Great Northern is not more than one mile. Mr. Dubelko indicated he was not <br />sure of the exact square-footage of Great Northern but, believed Mr. Tallon was correct. Mrs. <br />O'Rourke questioned if the parcels on the West Side of town were still in the Wireless <br />Communications Facilities overlay district and if they were why they were not indicated on the <br />maps they received. Mr. Dubelko reviewed that the parcels on the west side were still in the <br />Wireless Communications Facilities overlay district and the parcels indicated on the submitted <br />maps were parcels that will be added to the Wireless Communications Facilities Overlay District, <br />if approved. Mr. Spalding questioned if all the right of way along the interstate would be subject <br />to the Wireless Communications Facilities Overlay District. Mr. Dubelko answered "Yes," as that <br />is a matter of right; anyone can construct a pole as a matter of right within the I-480 right away. <br />To construct on these parcels it requires a conditional use permit.
