Tallon motioned to approve Fish Furniture Consolidation Plat; which is <br />required by the City to combine permanent parcels Nos. 231-29-014, 231-29- <br />015 and 231-29-027 into one (1) parcel, which is the current site of Fish <br />Furniture Company. Location is the North side of Lorain Road West of <br />Gessner Road. Zoning is Retail Business, General Entirely and the proposal <br />conforms to Zoning Code requirements for lot area, and is less non-confornung <br />to frontage requirements than currently exists. The motion was seconded by <br />K. O'Rourke and unanimously approved. Motion Carried <br />V. COMM[JNICATIONS: <br />The Planning Commission needs to chose a Chairman and Vice Chairman for <br />2000. <br />T. Hreha motioned to elect R. Tallon as Chairman. The motion was seconded by <br />W. Spalding and Unanimously approved. Motion Carried <br />W. Spalding motioned to elect R. Koeth as Vice Chairman. The motion was <br />seconded by K. O'Rourke and Unanimously approved. Motion Carried. <br />Mr. Dubelko indicated that he would like to update the Commissioners on current <br />court decisions, which relate to the Planning Commission. The VIII district court <br />of appeals reversed Judge, Gravens, of Rocky River Municipal Courts ruling in <br />connection with the 1998 ruling that North Olmsted's Urban Forest Ordinance was <br />unconstitutional. The case was a spin offto the Farcel E case, as the City sited the <br />owner of the property for violating the Urban Forest Ordinance by removing trees. <br />The owners had a permit to remove certain number of trees from the Army Core <br />of Engineers but they removed more trees then were permitted. They were sited <br />for removing trees without a permit. The owners filed a case on the grounds that <br />the Ordinance was unconstitutional. Judge Gravens dismissed the charges against <br />the landowner and the City appealed his ruling. Mr. Dubelko argued the case in <br />October of 1999 and Judge, Patricia Blockman ruled that the grievance be heard <br />again and that the constitutional issue be left out. The Urban Forest Ordinance is <br />back on the books. Mr. Koeth questioned what was happening with parcel E <br />currently. Mr. Dubelko indicated that the City appealed 7udge, Pokorny ruling on <br />February 3, 2000 and will take about a year to be heard. Mrs. O'Rourke <br />questioned if the landowners could develop their land or would they have to wait <br />until the case is settled. Mr. Dubelko commented that the parcel E landowners can <br />develop the site for office uses as that it what it is zoned. Mr. Spalding questioned <br />what was being done to establish a new sign chapter in the Zoning codebook. Mr. <br />Dubelko indicated that the Law Department put together a very rough draft of a <br />new Sign Code chapter, which was, based on "IMWA" which is the International <br />Municipal Lawyer Association. The Chapter will be referred to the Planning <br />Commissions next meeting. Sign chapter will require three readings, Planning <br />Commissions review, a public hearing and once it is passed it will be 30 days <br />2
