He does <br />not have any objections to the fence itself, just where and how it is being <br />secured. He would also like to have the posts secured with cement to make <br />sure it will withstand the weather. Mrs. Misiunas commented that she was not <br />against the fence but would like to see it cemented in place. Mr. Conway <br />indicated that the 24inch posts are not recommended for fences and questioned <br />the applicant as to how many 24inch post and 30-inch posts were used. He <br />indicated that he could not find any information on the new metal posts and <br />suggested that the board members request all 30inch posts be used. Mr. <br />Misiunas remarked hat the height of the flowerbeds needs to be lowered as <br />they effect the natural flow of water runoff. Mr. Puzzitiello indicated that if <br />the 30-inch posts were used he thought they would be fine. He asked the <br />applicants what size posts they use. Mr. Bill Fulmas suggested that there were <br />some 24inch posts as well as 30inch posts. Mr. Engoglia remarked that all the <br />posts needed to be 30inches and deeper in the ground. Mr. Pattwell indicated <br />that there are waste beds in the rear of the- property, which blocks the swell in <br />the back of all the yards. Mr. Puzzitiello indicated that there was a 10-foot <br />easement, which is a swell for drainage that must be maintained. Mr. Fulmas <br />indicated that the neighbor placed plastic on his side of the property which <br />keeps his water from flowing naturally. Mr. Engoglia questioned if the <br />commissioners would object to the posts being 30 inch. Mr. Conway strongly <br />recommended that the applicants work with the engineer department to make <br />sure grading of the yard is correct. Mr. Fulmas indicated that when they first <br />moved.in there was water sitting in the yard. He suggested that the city <br />suggested putting a pipe from the west to the East End of the yard but the <br />neighbor refused to let the water cross his yard. Mr. Engoglia informed <br />everyone present that the commission could not address the drainage issue as <br />they were present for the fence posts. Mr. Conway requested that if the <br />variance is granted he would like it predicated that it is to be inspected within a <br />year's time to see how it has held up. If the building department finds that the <br />fence posts are no long secured he would like the right to bring it back before <br />the board again. Mr. Engoglia questioned if Mr. Conway wanted to have a <br />specific period. Mr. Conway indicated that he would like to be able to have <br />the fence looked at any time within a year period. Mr. Pattwell indicated that <br />he lives on the West Side of applicant and there was a chicken wire fence that <br />he was told to remove in "1999". The illegal fence is already leaning because <br />the posts are not deep enough and cement was not used. His water is <br />supposed to flow and the neighbor is blocking the water from flowing. The <br />health department has had to come to his yard because of the bugs in the <br />water. He believes that the city is trying to take care of the water problem but <br />the ground is soft and cement should be used. Mr. Varga a friend of the <br />Fulmas commented that he would like to discuss the water issue. NIr. Engoglia <br />repeated his earlier comment that the board could not address any water issues. <br />Mr. Fulmas remarked that he felt that the neighbors were being allowed to <br />2
