<br />2) Edward O'Ma11eX; 6037 Porter Rd. <br />Pernut applied for: pool demolition & excavation of basement wall. Violation of <br />section 1333.01 (j), and 1365.01. (Removal of demolished and building material.) <br />Note: Prior to this proposal being placed on this agenda Clerk of Commissions, D. <br />Rote hand delivered notices to the following people on 4/18/01. Mr. Labianca, Mrs. <br />Weber, Mrs. Nash, Mr. Klatte, Mrs. Vanderhoof, Mr. Szule and Mr. O'Malley. Mr. <br />& Mr. Kadras were not home and the notice was left at their front door. Each of the <br />neighbors that were contacted voiced that they not only wanted Mr. O'Malley's <br />request heard, but they wanted his request granted, as it was a mess and was nothing <br />more then a breeding ground for mosquito's. Chairman Puzzitiello called all <br />interested parties forward to review the request. As the applicant was not present at <br />that time, the chairman announced that the board would come back to the proposal <br />after addressing the next case. Mr. Puzzitiello suggested that the pool debris should <br />be broken up and removed from the site. Mr. Klesta commented that as a contractor <br />he is concerned that if a new owner wanted to add to the home as soon as they start <br />to dig they would hit the pool debris. Mr. Engoglia indicated that the applicant <br />should bust out the cement and remove it from the site. Mr. Puzzitiello questioned <br />what the applicant was looking to remove. Mr. O'Malley questioned if he were to <br />remove the entire patio from around the pool and remove all that debris from the <br />site. He would then have the contractor break up the bottom of the pool and <br />remove a 2foot by 2foot section to allow for drainage. He would then backfill in the <br />hole. Mr. Klesta suggested that the pool bottom needed to be entirely broken up, <br />then remove a 3foot section for drainage and at least 4 feet of the sidewalls would <br />need to be broken up and removed. The patio around the pool should be broken up <br />and removed from the site. If someone wanted to add an addition, the footer has to <br />be at least 37inches. Mr. O'Malley suggested that he would put in a disclosure that <br />the pool was just back filled and let the owner take responsibility. Mr. Conway <br />commented that the board needed to uphold the code. Mr. O'Malley remarked that <br />the contractor stated that the yard was not big enough to get the equipment to <br />remove all the debris in the back yard. Mr. Puzzitiello remarked that if the applicant <br />worked with the board by removing the top 3 feet of the walls and breaks up the <br />bottom of the pool for drainage the board could grant his request. Mr. Klesta <br />indicated that from top grade down 3 feet there can be no concrete. The patio is to <br />be broken up and entirely removed from the property. Mr. Rymarczyk questioned if <br />the board wanted only clean dirt used to back-fill the opening. Mr. Klesta indicated <br />it would have to be clean fill dirt. Mr. O'Malley agreed to do what the board <br />requested. <br />R. Klesta motioned to allow Edward O'Malley of 6037 Porter Rd. the following <br />approval; from grade to 42inches below grade and all concrete and debris must be <br />removed from site. The bottom of the pool has to be busted-up for drainage. The <br />back fill that is used has to be clean fill. This is in violation of section 1333.01 (j), <br />and 1365.01. (Removal of demolished and building material.) If and when the <br />applicant sales the home a disclosure must be written indicating what was done. The <br />motion was seconded by R. Puzzitiello and unanimously approved. Motion <br />Carried. <br />2
