Kremzar motioned to grant James Fetterman of 25082 Randall Drive his request for variance <br />(1123.12) as amended: which consists of building a shed and that the following variances be granted: <br />1) A 5 ft: variance for rear lot line setback (code requires 10 ft., applicant shows 5 ft), section <br />(1135.02 D-4). <br />2) A 28 square ft. variance for exceeding 2% lot coverage (code permits 52 square ft., applicant <br />shows 80 square ft.), section (1135.02 D-1). Which is in violation of Ord. 90-125 section, <br />1135.02 D- l, and 1135.02 D-4. The motion was seconded by J. Konold and unanimously <br />approved. Ga-anted 10-4-01 <br />2. Edward J. Majercak, Jr.; 4521 Porter Rd. <br />Request for variance (1123.12). The proposal consists of building a fence. The following variance is <br />requested: <br />1) A 20 ft. variance for building a six (6) ft. fence in the required 50 ft. setback (code requires 50 ft., <br />applicant shows 3 0 ft.), section (113 5.02 F-1). <br />Which is in violation of Ord. 90-125 section, 1135.02 F-1. <br />Note: Fence is existing and was constructed with a permit (improperly). Intrudes 20 ft. into required <br />50-ft. setback. <br />Chairman IVlaloney called all interested parties forward to review their request. Nlr. Majercak the <br />owner came forward to be sworn in and review his request. Mr. Majercak indicated that his fence <br />was already in place because, he did not know he needed a permit to put up his fence. His home is a <br />corner lot and exposes his home to all the traffic going north on Porter road. He has no privacy at all <br />on his lot, with the increase of traffic •along Porter Road. He put up a 6 foot fence which was brought <br />to the edge of his home. He misunderstood were and how the measurements were to be taken when <br />he placed his fence. Mr. 1Vlaloney questioned if the fence would extend any further then what it <br />currently was. Mr. Majercak stated " NO". Each board member indicated that they felt the variance <br />was warranted. <br />J. Konold motioned to grant Edward J. Majercak, Jr. of 4521 Porter Road his request for variance <br />(1123.12), which consists of building a fence and that the following variance be granted: <br />2) A 20 ft. variance for building a six (6) ft. fence in the required 50 ft. setback (code requires 50 ft., <br />applicant shows 30 ft.). Which is in violation of Ord. 90-125 section, 1135.02 F-l. The motion <br />was seconded by W. Kremzar and unanimously approved. Granted 10-4-01. <br />3. Dennis & Laura Schreiber: 5106 Lucvdale Ave. <br />Request for variance (1123.12). The proposal consists of building a shed. The following variances <br />are requested: <br />1) A 5 ft. variance for rear line setback (code requires 10 ft., applicant shows 5 ft.), section (1135.02 <br />D-4). <br />2) A 30 square ft. variance for exceeding 2% of rear yard (code permits 66 sq. ft., applicant shows <br />96 sq. ft.), section (1135.02 D-1). <br />Which is in violation of Ord. 90-125 section, 1135.02 D-1 and 1135.02 D-4. <br />Chairman Maloney called all interested parties forward to review their request. Mr. & Mrs. Schreiber <br />came forward to be sworn in and review their request. Mr. Schreiber indicated that they do not have <br />a garage. The sewer line runs across the yard not to the back so they can not put in a garage. Mrs. <br />Schreiber reviewed that currently they have to store everything in their basement. Mr. Konold <br />2
