a <br />I <br />questioned when the applicants thought they would be building a garage. Mrs. Schreiber indicated <br />that they would never put a gaxage in over the sewer lines. Each of the board members indicated that <br />they felt the variances were warranted. <br />J. Konold motioried to grant Dennis & Laura Schreiber of 5106 Lucydale Ave. their request for <br />variance (1123.12), which consists of building a shed and that the following variances be granted: <br />1) A 5 ft. variance for rear yard setback (code requires 10 ft., applicant shows 5 ft.), section <br />(1135.02 D-4). <br />2) A 30 square ft. variance for exceeding 2% of rear yard (code permits 66 sq. ft., applicant shows <br />96, sq. ft.), section (1135.02 I?-1). Which is in violation of Ord. 90-125 section, 1135.02 D-1 and <br />1135.02 D-4. The motion was seconded by T. Koberna and unanimously approved. Granted 10- <br />4-01. <br />4. Richard Richardson• 23244 Woodview Dr. <br />_ Request for variance (1123.12). The proposal consists of an accessory structure (gazebo). The <br />following variance is requested: <br />1) A 2-ft. plus or minus variance for height of accessory structure (code permits 12 ft., applicant <br />shows 14 ft. plus or minus), section (113 5.02 D-1). <br />Wluch is in violation of Ord. 90-125 section, 1135.02 D-l. <br />Chairman Maloney called all interested parties forward to review their request. Mr., Rains, the <br />contractor with Amish Country Builders came forward to be sworn in and review the applicant's <br />request. Mr. Rains indicated that the owner would Iike a gazebo, which will need a platfonn because <br />of the topography of his yard (rear yard slops). The owner would like to have a I2-foot gazebo, <br />which is within code. The platform is needed to assure that the gazebo is level. It will put the height <br />over the maximum 12 foot allowed. The chairman questioned if there were any questions from board <br />members or audience members. No further comments were made. J. Konold motioned to grant Richard Richardson of 23244 Woodview Drive his request for variance <br />(1123.12), which consists of an accessory structure (gazebo) and that the following variance be <br />granted: <br />1) A 2-ft. plus or minus variance for heiglit of accessory structure (code permits 12 ft., applicant <br />shows 14 ft. plus or minus). Which is in violation of Ord. 90-125 section, 1135.02 D-1. The <br />motion was seconded by T. Koberna and unanimously approved. Granted 10-4-01. <br />5. Paul & Jean Winslow; 24396 Maple Ridge Rd• <br />Request for variance (1123.12). The proposal consists of detached garage. The following variance is <br />requested: ` <br />1) A 3-ft. variance for side lot line (code permits 5 ft., applicant shows 2 ft.), section (1135.02 D-4). <br />Which is in violation of Ord. 90-125 section, 1135.02 D-4. <br />Chairman Maloney called all interested parties forward to review their request. Mr. & Mrs. Winslow; <br />the owners came forward to be sworn in and review their request. Mr. Winslow indicated that the <br />current garage was very old and was rotting away. Currently the existing garage is 2-feet from the <br />property line, he would like to build the new garage in the same spot. When the project first started <br />only the concrete was going to be replaced, however it was found that the structure is in such poor <br />condition that it also should be replaced. His yard is only 55-feet wide and today's code d'ictates that <br />the garage be placed 5-feet from the side yard line. It was discussed that with the existing angle of <br />the home and driveway placing the garage to code would be very difficult. Mr. Maloney questioned <br />if the garage would have drainage. Mr. Winslow indicated that there would be downspouts however, <br />he would like to just run the water into his yard not a drain. 1V1i-. Conway commented that the <br />3
