Koberna motioned to grant Horizon Activities Center of 4001 David Drive their request for <br />variance (1123.12), which consists of the placement of a school bus shelter and that the following <br />variances be granted: <br />1) A 60 ft. variance for front yard setback from right of way (code requires 75 ft., applicant shows <br />15 ft.). <br />2) A 3.5 ft. variance for side yard setback abutting nonresidential use (code requires 10 ft., applicant <br />shows 6.5 ft.). <br />Which is in violation of Ord. 90-125 section, 1139.07. W. Kremzar seconded the motion. Role call <br />on the motion; J. Maloney, T. KoUerna and W. Kremzar, "yes", J. Konold "abstain". Granted 10-4- <br />01 <br />12. Kronheim's Furniture (Expansion5198 Great Northern Plaza-South <br />Request for variance (1123.12). The proposal consists of expanding the existing structure by 7,250 <br />square feet. The following variances are requested: <br />1) A 25 ft, variance for front setback (code requires 75 ft., applicant shows 50 ft.), section <br />(1139.07). <br />2) A 2.2% variance for lot coverage (code permits 25%, applicant shows 27.2%), section (1139.05). <br />3) A 30 space variance for total parking (B.Z.A. requires 2,938 spaces, applicant shows 2,878 <br />spaces), section (1161.05) as modified by B.Z.A. <br />Which is in violation of Ord. 90-125 section, 1139.07, 1139.05, and 1161.05. <br />Note: Lot is not a corner lot (see map 235-28), but fronts on street. Lot coverage is based on total <br />development. B.Z.A. granted a variance of 4.5 spaces per 1,000, but developer is seeking further <br />reduction to 4.4. <br />Chairman Maloney called all interested parties forward to review their request. Mr. Fisher; an <br />Attorney, Mr. Ogrinc; with Developers Diversified, Mr. Hough; Development director and Mr. <br />Koreness; with the Ohio State Bar Association came forward to be sworn in and review the <br />applicants request. Mr. Fisher introduced each of the representatives and indicated that Kronheim's <br />was doing well and would like to expand their existing show room. The planning comtnission has <br />requested that the variances required be approved. They would like to make it known that the side of <br />the building, which will be expanded, does not currently have an entrance nor will it if the addition is <br />approved. Mr. Maloney questioned if the existing parking along the rear of the building would <br />remain and who would use them. Mr. Hough indicated that the spaces would remain and employees <br />or customers could use the parking spaces. Mr. Gareau indicated that even though the number of <br />parking spaces required are calculated by the square footage of the building the board should take <br />into consideration that this is a furniture.store, not a gr.ocery store that generates multiple customers. <br />He questioned the request to use part of the Regal Cinema's parking. Mr. Conway indicated that the <br />applicants proposed that at some point in the future they would raise part of the theater as the square <br />footage/parking lot trade off. He feels that that would be too difficult to oversee, so he suggested <br />that they make a proposal flat out that it will be built with so many parking spaces. The theater could <br />be addressed at another date in the future, there is not much traffic on this side of the strip center. <br />Mr. Kremzar questioned the request to go from 4.5 to 4.4 ratio. Mr. Conway indicated that that was <br />just for a reference number. He really does not think the city should go below the 4.5 ratio and the <br />board should treat the case on its own merit as a furniture store. Each board member voiced that <br />they had no objections to the request. No further comments were made. <br />7
