Maloney motioned to grant Jacob Moskalsky of 3884 Canterbury Road his reguest for variance <br />(1123.12) as amended, which consists of building a(5-ft.) fence and that the following variance be <br />granted: <br />1) A 30 inch variance for fence exceeding 30 inch hiah on a corner lot in the required 50 ft. setback <br />on the abutting street (code pernuts 30", applicant shows 60"). <br />Which is in violation of Ord. 90-125 section, (1135.02 F-2). The proposal consists of building a fence. The following variance is <br />requested: _ <br />1) A 12 inch variance for fence (42") exceeding 3 0" high on a corner lot in the required 50 ft. <br />setback of the first house on the abutting street (code permits 30 inch, applicant shows 42 inch). <br />Which is in violation of Ord. 90-125 section, 1135.02 F-2. <br />Chainnan Maloney called all interested parties forward to review their request. Mr. & Mrs. <br />Hendrickson the owners came forward to be sworn in and review their request. Mr. Hendrickson <br />indicated that he would like to place a fence in his backyard, which will go from the back end of the <br />home and line up with the shed at the back end of the yard. Placing the fence where we want puts the <br />fence within the 50-foot setback requirement. If the fence is placed according to the city code it <br />would end up across their patio. They have dogs and they would like to let them have room to play. <br />Mr. Kremzar indicated that when he visited the site he noticed part of the fence was already in place. <br />Mr. Hendrickson indicated that he had a permit for that part of the fence as it is within code. No <br />further cominents were made. <br />W. The proposal consists of location for new school bus shelter. The <br />following variances are requested: <br />1) A 60 ft. variance for front yard setback from right of way (code requires 75 ft., applicant shows <br />15 ft.), section (1139.07). <br />2) A 3.5 ft. variance for side yard setback abutting nonresidential use (code requires 10 ft., applicant <br />shows 6.5 ft.), section (1139.07). <br />Wliich is in violation of Ord. 90-125 section, 1139.07. <br />Chairman Maloney called all interested parties forward to review the request. Mr. Dave Smith; the <br />Director of Horizons came forward to be sworn in and review the request. Mr. Smith indicated that <br />they would like to place a school bus shelter along Lorain Road so the kids would not be exposed to <br />the elements. The shelter will be glass and very similar to the shelter located on Fleharty Road. <br />Uniformly the board members indicated that they had no objection to the request. No further <br />cornments were made. <br />6
