Mr. Moskalsky indicated that it would be dog-eared shadow boxed to match what is currently in place. J. Maloney motioned to grant Jacob Moskalsky of 3884 Canterbury Road his reguest for variance (1123.12) as amended, which consists of building a(5-ft.) fence and that the following variance be granted: 1) A 30 inch variance for fence exceeding 30 inch hiah on a corner lot in the required 50 ft. setback on the abutting street (code pernuts 30", applicant shows 60"). Which is in violation of Ord. 90-125 section, (1135.02 F-2). The motion was seconded by J. Konold and unanimously approved. Granted 10-4-01 10. William Hendrickson: 27459 Lusandra Circle Request for variance (1123.12). The proposal consists of building a fence. The following variance is requested: _ 1) A 12 inch variance for fence (42") exceeding 3 0" high on a corner lot in the required 50 ft. setback of the first house on the abutting street (code permits 30 inch, applicant shows 42 inch). Which is in violation of Ord. 90-125 section, 1135.02 F-2. Chainnan Maloney called all interested parties forward to review their request. Mr. & Mrs. Hendrickson the owners came forward to be sworn in and review their request. Mr. Hendrickson indicated that he would like to place a fence in his backyard, which will go from the back end of the home and line up with the shed at the back end of the yard. Placing the fence where we want puts the fence within the 50-foot setback requirement. If the fence is placed according to the city code it would end up across their patio. They have dogs and they would like to let them have room to play. Mr. Kremzar indicated that when he visited the site he noticed part of the fence was already in place. Mr. Hendrickson indicated that he had a permit for that part of the fence as it is within code. No further cominents were made. W. Request for variance (1123.12). The proposal consists of location for new school bus shelter. The following variances are requested: 1) A 60 ft. variance for front yard setback from right of way (code requires 75 ft., applicant shows 15 ft.), section (1139.07). 2) A 3.5 ft. variance for side yard setback abutting nonresidential use (code requires 10 ft., applicant shows 6.5 ft.), section (1139.07). Wliich is in violation of Ord. 90-125 section, 1139.07. Chairman Maloney called all interested parties forward to review the request. Mr. Dave Smith; the Director of Horizons came forward to be sworn in and review the request. Mr. Smith indicated that they would like to place a school bus shelter along Lorain Road so the kids would not be exposed to the elements. The shelter will be glass and very similar to the shelter located on Fleharty Road. Uniformly the board members indicated that they had no objection to the request. No further cornments were made. 6
