approved. Variance Granted W/Condition 7/5/01. <br />6. Jack Perrella; 4455 Brendan L,ane: <br />Request for variance (1123.12). The proposal consists of an addition to existing home. <br />The following variance is requested: <br />A 23 foot variance for required rear yard setback, (code requires 50 ft., applicani shows.27 ft.). <br />Which is in violation of Ord. 90-125 section, (1135.08 A). <br />Chairman Maloney called all interested parties forward to review the request. The oath was administered <br />to Jack & Deborah Perrella, the owners, Pattie & Tom Stipek, neighbors at 4441 Brendan Ln., whom all <br />came forward to review the request. Mr. Perella indicated that they are putting an addition on their <br />house and it is going to make their back yard a lot smaller, but they want this addition. Mrs. Perrella <br />commented that they have had three contractors come out and give their different opinions as to where <br />exactly to place this addition. Each of the contractors suggested placing the addition off the dinin; room, <br />which is right next to the Stipek's home. Mr. Konold questioned if the contractors were all for this <br />drawing they are looking at tonight. Mrs. Perrella replied no, but they did all suggest placing it on that <br />side. Mr. 1Vlaloney questioned if the Stipek's had comments or questions. Mr. Stipek suggested that they <br />had discussed all their concerns with the Perella's and was present for moral support. They have a sick <br />baby and they were worried about the noise problems. Mrs. Perrella indicated that they were going to <br />have their builder come and talk to them to see if there is anyway to keep the noise at a minimum. Mr. <br />Koberna indicated that he is concerned with the actual physical size of it. You are only going to have 27 <br />ft. from the back of the addition to the rear lot Iine. There are some swing sets and whatnot off your <br />property in the backfield. If that property is ever sold off and you have to bring all this stuff back into <br />your yard, it will really squeeze things in there. Mr. Koberna commented that the one tree is going to <br />have to come down. Mrs. Perrella indicated yes, they would be taking that tree down. Mr. Rymarczyk <br />indicated that if they brought the shed back onto their property then they would probably have to come to <br />this board for a variance. The Building Department takes into account the percentage of rear yard that is <br />being used for determining the size of shed allowed and the applicant is really crunching it quite a bit. <br />Mrs. 1'errella indicated that they were thinking about putting the addition off the family room, but the <br />family room part of the house is on a slab and it is too hard to tie into the utilities there. Mr. Maloney <br />indicated that he is concerned with them having a wall the length of their property and he would be more <br />in favor of turning it to run parallel with the back of the house. Mrs. Perrella suggested that would block <br />her view from the kitchen window and she needs to be able to keep an eye on her kids. Mr. Koberna <br />again suggested that the wall is huge and there is nothing to break that up. Mr. Kelly questioned if the <br />property behind them was land Iocked. Mrs. Perrella indicated that she is not positive, but neighbors <br />have told her that. Mr. Gareau indicated that Mr. Klingman owns the land and the problem is that on the <br />south end there is no means of access. There is very little build-able property on the west side and there <br />is no means of ingress or egress on Clague Road, because of all the houses. The applicant would not <br />have enough side yard if they put a street in. There is just not enough land to build on. They tried to <br />come through and develop it, but it was turned down by the Planning Commission and Board of Zoning <br />Appeals many years ago. 1VIr. Maloney called for a motion. _ <br />W. The motion was seconded by T. Koberna. <br />Roll call on the motion: T. Kelly, J. Konold, "yes", W. Kremzar, T. Koberna, and J. Maloney "no". <br />Motion failed to pass. Variance Denied 7/5/01.
