ROLL CALL: <br />Chairman,lVlaloney called the meeting to order at 7:35 p.m. <br />PRESENT: Chairman, J. Maloney, Board members, T. Koberna, J. Konold, W: Kremzar and T. Kelley. <br />ALSO PRESENT: Law Director, M. Gareau, Building Commissioner, D. Conway and Asst. Clerk of <br />Commissions, S. Solomon. <br />II. REVIEW AND CORRECTION OF MINUTES: The Board of Zoning Appeals minutes of May 3, 2001 <br />have .been submitted for review. <br />J. Konold motioned to approve the Iv1ay 3, 2001 Board of Zoning Appeals minutes as corrected by J. <br />Maloney. The motion was seconded by W. Kremzar and unanimously approved. Approved 6/7/01. <br />J. Maloney advised that each board member had viewed the premises involved for each case. Three votes <br />are required for approyal. In addition each case will be judged on the physical situation peculiar to itself, <br />so that in no way is a judgment rendered considered to be a general policy judgment affecting properties <br />and like situations elsewhere. <br />III. BUII,DING DEPARTMENT REQUESTS: <br />William Randel; 82973 Stonevbrook:Dr. <br />Request for variance (1123.12). The proposal consists of building a shed. The following variances are requested: <br />1) A six (6) foot variance for rear property line setback (code requires 10 ft., applicant shows 4 ft.), <br />section (1135.02 (D-4)). <br />2) A two (2) foot variance for side property line setback (code requires 5 ft., applicant shows 3 ft.), <br />section (1135.02 (D-4)). <br />3) A 21 sq. ft. variance for square footage exceeding 2% of the rear yard (code permits 59 sq. ft., <br />applicant shows 80 sq. ft.), section (1135.02 (D-1)). <br />Which is in violation of Ord. 90-125 section, 1135.02 D-1 and 1135.02 D-4. <br />Chairman Maloney called all interested parties forward to review the request. The oath was administered <br />to William and Bettie Randel, the homeowners, who came forward to review the request. Mr. Maloney <br />reviewed the variances requested for the shed and indicated that he had no problem with it. Mr. Koberna <br />agreed, with the peculiar situation with the lot it shouldn't be a problem. Mr. Randel indicated that the lot <br />shape was the big problem. Mr. Maloney called for a motion. <br />J. Konold motioned to grant William Randel of 22973 Stoneybrook Dr. his request for variance <br />(1123.12). Which consists of a shed and that the following variances be granted: <br />1) A six (6) foot variance for rear property line setback (code requires 10 ft., applicant shows 4 ft.), <br />section (1135.02 (D-4)). <br />2) A two (2) foot variance for side property line setback (code requires 5 ft., applicant shows 3 ft.), <br />section (1135.02 (D-4)). <br />3) A 21 sq. ft. variance for square footage exceeding 2% of the rear yard (code pernuts 59 sq. ft., <br />applicant shows 80 sq. ft.), section (1135.02 (D-1)).
