Kremzar motioned to grant Darin McEleney of 26971 Butternut Ridge Rd. the variances as <br />requested with the exception that the fence must be at least 1 foot offthe sidewalk and that they <br />coincide with the Landmarks Coinmission decision to have the privacy fence on the eastern 10 ft. <br />section of the house. J. Konold seconded the motion and was unanimously approved. Granted <br />4/5/Ol <br />4. Wallv Grobelnv; 3522 Clague ltd. <br />Request for variance (1123.12). The proposal consists of a detached garage with game room <br />above. The following variances are requested: <br />1) A 420 sq. ft. variance for permitted detached garage area and car port (code permits 750 sq. <br />ft., applicant shows 1,170 sq. ft.), section (1135.02 C-1). <br />2) A 8 ft. variance for permitted height (code permits 15 ft., applicant shows 23 ft.), Section <br />(1135.02 C-1). <br />3) A use variance for creating a game room above detached garage (with restroom) (code <br />permits garage and storage, applicant shows game room and bath), section (1135.02 C-1). <br />Which is in violation of Ord. 90-125 section, 1135.02 C-l. <br />Chairman 1Vlaloney called all interested parties forward to review the proposal. The oath was <br />administered to Wally and his wife Colleen Crrobelny, the owners, who came forward to review <br />the proposal. Mr. 1Vlaloney inquired if tfiey could explain to the board what they want to put in <br />their backyard. Mr. Grobelny commented that he has an existing old garage that he would like to <br />tear down and put a new one up. He is proposing a two-car garage with a carport along side of <br />it. Above the garage he would like to have a game room / recreation room. His basement cannot <br />be converted into a recreation room because the ceiling is only about six feet high. He would like <br />to put a pool table and ping pong table up there. They are proposing a restroom on the second <br />floor. There is pool behind the garage and when guests are over they can use the garage restroom <br />instead of tracking water inside the house. 1VIa-. Maloney questioned if the new garage would be <br />22' x 35' and then the carport will be 10° 1/2" x 35'. Mr. Grobelny replied yes. Mr. Maloney <br />commented that he is concerned with a fire hazard with the second floor in the new garage. Mr. <br />Kremzar indicated that they showed a wood burning stove up there and questioned what safety <br />precautions they would take. Mrs. Grobelny commented that there is a protective coating of <br />course and they do have a wood-burning stove in their house now. They keep it clean and <br />maintain it foz- safety purposes with their kids being there. Mr. Grobelny commented that they <br />could keep a fire extinguisher up there. Mr. Kremzar commented that if they do have a fire they <br />only have one exit out of the garage. Mr. Rymarczyk commented that the board should be <br />looking at the use permit for it. NIr. Konold questioned if they are doing this just for theinselves. <br />Mr. Grobelny replied yes. Mr. Kelley commented that they show windows on the second floor <br />and in the case of a fire they could possibly have a rope ladder or something to help people escape <br />through the window. Mrs. Grobelny commented that they do have one upstairs now. Mr. Gareau <br />- commented that they couldn't condition a variance over things of that nature because what if four <br />years from now the rope ladder wasn't there. Those are concerns you ought to have, but they are <br />personnel concerns that would be have to meet the O.B.O.A. Code. Mr. Kremzar questioned if <br />the building department has stated .that it will conform. Mr. Rymarczyk replied that they haven't <br />reviewed it as such, but it probably will. Mr. Koberna commented that this is not a building that <br />is meant for residency, but rather just part time use. Mr. Gareau commented that they should <br />condition the variance upon the idea that it should not be used for a residential dwelling. So that <br />10 or 15 years from now, if the Grobelny's sell it and somebody else moves in and wants to rent <br />the upstairs in the garage to somebody, then they could go look on the building card which would <br />have a copy of these minutes that show they are not allowed to use it for residency. <br />3
