Dedication Plats for two (2) various properties as listed below: <br />This plat is for the right-of-way takes required by the City of North Olmsted for access to the <br />GCRTA Park-N-Ride lot. We are requesting Planning Commission approval subject to the City <br />either obtaining the property owners signature by negotiation or by court order. <br />PP No. 236-11-017 25736 Butternut Ridge Rd North Olmsted Evangelical Church <br />PP No. 236-12-004 Kennedy Ridge Road Great Northern 1'roperties <br />Chairman Tallon questioned if anyone was present to review this proposal. Meribeth Feke, <br />Director for RTA, indicated that her and her colleague were both present. Mr. Spalding <br />commented that presumably the shaded areas are the proposals. Mr. Tallon replied right, they <br />have to acquire that property to get into the site for the RTA Park-N-Ride. Mr. Tallon <br />questioned who owned the triangular parcel to the north of the properties they are trying to <br />acquire. Mr. Deichmann replied that Great Northern Properties owned that triangular piece to <br />the north. Ms. O'Rourke questioned if the Church owned the other part. Mr. Deichmann replied <br />yes. Mr. Spalding questioned where the traffic lights were in relation to this. Mr. Deichinann <br />indicated that the on ramp is right next to triangular parcel to the north of the dedication area. <br />The off ramp is opposite the area for dedication from the Church parcel. Mr. Spalding replied <br />that he knew they were going to use that light to access this parking and questioned if that still <br />would be usable with this. Mr. Deichmann replied yes. Mr. Tallon questioned if Great Northern <br />properties owned all the property where this is going. 1VIr. Deichmann replied no, RTA owns the <br />tlu-ee large greenhouse parcels. Great Northern Properties owns the triangular piece. Mr. Tallon <br />questioned if that was all they owned. Mr. Deiclunann replied yes. Mr. Tallon questioned what <br />the permanent parcel numbers were for the shaded ones. Mr. Deichmann indicated that the <br />southern most parcel that is shaded is owned by the Church and is #236-11-017. The longer <br />reverse shaded parcel above it is owned by Great Northern Properties and is #236-12-004. Mr. <br />Tallon questioned if there was a reason that they did not include the triangle piece at this time. <br />Mr. Deichmann indicated that it is not being addressed at this time, but it will be addressed at a <br />later date. Mr. Spalding commented that these parcels are necessary to provide access to the <br />back area where the Park-N-Ride will be. Mr. Deichmann replied correct. Mr. Ta11on <br />questioned if the triangle piece was necessary to get in there. Mr. I3eichmann replied yes. W. <br />Tallon questioned why they aren't addressing it now. Mr. Deichmann commented that he was <br />not part of that decision process, so he couldn't really speak to that. Mr. Tallon invited anyone <br />from the audience who wished to speak forward at this time. Walter Sheffield, a resident of <br />4553 Ashbury Park Dr. and presiding elder of the North Olmsted Friends Church, came forward <br />to speak. He questioned if the City or RTA was attempting to buy their property because the <br />way the notice reads is "the City takes", which to him is a good word. Mr. Dubelko indicated <br />that it is the City that would buy their property. Mr. Sheffield questioned then why is RTA <br />supposedly negotiating with them. Mr. Dubelko indicated that the City has eminent domain <br />powers, so the City would be the one purchasing it. Obviously, the overall proposal is to have an <br />RTA Park-N-Ride and he would presume that RTA certainly has the authority to purchase the <br />land from the Church and Great Northern Properties, but they don't have authority to exercise <br />powers of eminent domain to acquire it. If it can't be purchased then the City would be the <br />entity that would go forward and seek what is required through its exercise of eminent domain <br />powers. The City is working hand in hand with RTA. Mr. Sheffield indicated that this is a <br />change of direction right this moment for his Church having met with RTA a number of times, <br />they said they had eminent domain and that they were a government entity and that they had the <br />right to do that. Mr. Dubelko indicated that he thinks they do have eminent domain powers and <br />questioned if Ms. Feke knew for sure. Ms. Feke commented that they do have the right and <br />authority to take property through eminent domain, however they do not have quick take. W. <br />2
