It just seemed like at this point, since the Lube Shop was <br />agreeable to selling it, it seemed like it would be a nice future plan to have when additional <br />parking would be needed. Mrs. O'Rourke questioned parcel "A". Mr. Mills indicated that parcel <br />"A" is the Collision Center's and their lot goes very deep. It is mostly wooded because there is a <br />fence at the rear of the parking.lot. Mr. Deichmann indicated that the Lube Shop parcel is <br />already below the minimum requirements, so they would need a variance because they are <br />reducing the lot size even further. Mr. Mills commented that he has shared with the Lube Shop <br />the dimensions and the drawing's in where things come up and in fact, dependina upon the <br />actions here tonight, he would fax the Lube Shop to get permission to ar-ue on their behalf <br />because he would have to represent their interests as well to the Board of Zoninc, Appeals to <br />permit this to occur. Mr. Tallon questioned if they .are creating a density problem on the Lube <br />Shop property. Mr. Mills indicated that they had one and it is not getting any better. Mr. Tallon <br />indicated that it would stil] be a nonconforming development. Mr. Deichmann replied that he <br />was correct. Mr. Tallon invited anyone in the audience with questions to come forward. Zack <br />Hoty, on behalf of CU Center West to the east of this property, indicated that he had not seen any <br />drawings at all and just wanted to take a minute to look at them and maybe have Mr. Mills <br />explain what is going on. Mr. Mills took a minute to explain what was goina to happen. Art <br />Pietraroia, from 5580 McKenzie Rd. caine forward to see what was happening also. Mr. Mills <br />explained what would take place. Mr. Pietraroia questioned what happened to the easement that <br />was on the property in question. There was an easement for the storm sewer manholes there. <br />Mr. Tallon questioned if Mr. Deichinann knew anything about an easement along the rear- <br />property line. Mr. Deichmann replied no, but they could check into it. Mr. Mills explained that <br />if the easement was there then it probably still is. If they were to build over an easement and <br />somebody needed to get to the easement, they would have the riaht to tear out what has been <br />built to gain access to that easement. <br />R. Tallon motioned to approve the lot split and consolidation for North Olmsted Collision/ Lube <br />Shop of 28401 Lorain Rd. as subinitted and based on the Board of Zoning Appeals decision on <br />the variances needed to cotnplete the proposal. The inotion was seconded by K. O'Rourke and <br />was unanimously approved. Approved. Note: If the Board of Zoning Appeals doesn't grant the <br />variances, the proposal is null and void. <br />V.
