Tallon indicated that the City still owned Parcel B. Mr. Dubelko reviewed that the City owned <br />the entire property for easement purposes. Now the City will own part of the land with free title <br />and the balance that was purchased from Mr. Kronz will have an easement through it for storm <br />water purposes. Mr. Deichmann indicated that there has been questions regarding the water <br />treatment plant parcel to the rear, which is not before this board. Even though the applicant does <br />intend to make it part of this parcel in the future. If the rear portion of the McCool property was <br />sold to Mr. Kronz, he would have to make application to go before this board to consolidate all of <br />the land. If and when that ever happens, a larger notification would be called for. However, the <br />legal notification that was plotted for this proposal only pertains to the parcel before the board <br />this evening. It was the understanding of the Engineering Department that Mr. McCool was <br />opened to a sale. Time was allowed to see if the sale would take place, but as it has not, this is <br />the situation the City is left with. Mr. Tallon invited the audience members to come forward to <br />address the proposal. Mrs. Prince, a neighbor indicated that she has lived in the area for 16 years. <br />She has always been told that the land was not buildable. She questioned why the residents were <br />not notified when the sale of the land was taking place as no one was told. Mr. Tallon reviewed <br />that neither the rear lot nor the front lot was buildable today, unless Mr. Kronz purchases part of <br />the McCool property and combines all three pieces of land. Mrs. Prince questioned how the lots <br />could be sold if they were not buildable. Mr. Tallon repeated how the land could be made <br />buildable. Mrs. Prince indicted that it seamed that any green space that is left in the city is going <br />to waste. Councilman of Ward 3, Nashar indicated that this is in escrow pending the sale of the <br />third lot that is proposed. Until the details of the third lot, which is needed to complete, the deal <br />was explained to him in more detail by the engineering department, he did not have a complete <br />understanding of what was taking place. Ten or eleven years ago, the lots in question came <br />before the City and it was determined at that time that the lots were not buildable. Councilman <br />Nashar believed that it was not clear if the sale was a done deal and everything should be taken <br />into consideration. IVIrs. Ballinger, a neighbor is concerned about what the requirements of a new <br />home would be if one were built on the lots. She does not want to see a home that is oversized <br />for the neighborhood. Mr. Tallon indicated that the lots in the neighborhood are zoned B <br />residential and the zoning code would dictate the requirements of a new home. Mrs. Ballinger <br />questioned if a home on the lots could be twice the size of the existing homes as that would be <br />disrespectful of the other homeowners in the neighborhood. Mr. Conway indicated that the <br />zoning code stipulates not more then 25% lot coverage. Mrs. Ballinger questioned why the <br />property was not placed on the open market to give other homeowners in the area a chance to <br />purchase the lots. Mr. Tallon indicated that he could not answer her question and advised her to <br />contact the administration or Council to get an answer. Mrs. Hickernell a neighbor who abuts the <br />rear property that was sold to Mr. Kronz indicated that she is concerned about the storage tanks <br />that were left in the ground when the water treatment plant was moved. She is concerned about <br />chemicals being released when heavy equipment is brought in to build a home and the <br />underground tanks being damaged. Mr. Tallon indicated that as the engineer stated earlier that <br />parcel is not in question at this meeting tonight. This board can only address that parcel if the <br />applicant purchases the McCool property and applies to have them combined. Mrs. Hickernell <br />questioned how she could find out what is buried under the rear lot. Mr. Deiclunann the City <br />engineer indicated that he was not sure what is or is not on the land at this time. He explained <br />that until the applicant acquires all the land he needs and applies to consolidate the land what is or <br />is not on the land would only be addressed during the building permit process.
