association be notified. The Planning Commission has the authority to make additional notices if it ? <br />wants too, if they believe that it will further the intent of the ordinance. Mrs. Spalding questioned how <br />the homeowners association would be notified. Mr. Dubelko indicated that the secretary of the <br />association should receive the notice. However, the ordinance is short on how a homeowners <br />association should be notified and it should either be changed to provide a better notice for those <br />residents. Alternatively, the Commission by rule can indicate in the future that every time there is <br />condominium homeowners associations involved give notice to the association through the secretary. <br />Mrs. Spalding commented that she would give the clerk the name and address of the secretary of the <br />board and the management. Mr. Miller indicated that he was not sure how it can be called a museum <br />per say when for the most part it sounds like it will be an office building. Basically, it is an office <br />building with a little bit of inemorabilia housed in a room. The city has codes regarding office buildings <br />and where they should be located. His question is how does this variance needed relate to a museuin. <br />Councilmen McKay indicated that he is concerned about the golf balls hitting the homes, and he is glad <br />that that will not be happening. The developer (Mr. Bower) indicated that he would be contacting the <br />homeowners association to inform them of everything going on. Therefore, Council assumed that was <br />done. Mrs. Messing questioned if the building would face Canterbary road. She is concerned about the <br />lighting of the building. 1VIrs. Feldman indicated that the green space was provided to justify the density <br />of the homes that are in viewpoint development. Removing any part of the green space she does not <br />believe was allowable. She disagrees with the law departments ruling regarding not having to notify <br />every owner as well as the association. Mr. Spalding questioned if there were any questions regarding <br />the height of the building. Mrs. Morgan suggested that the buildino, will be mostly a headquarters not a <br />museum. Mr. Meyer the president of the association indicated that he felt that the addition would be a <br />nice addition and complementary to accommodate what is presently there. The green space that has <br />been questioned is now a construction trailer with a gravel driveway that spreads gravel all over the <br />parking lot. The improvements that will be done to the golf course and the services that will be <br />provided will is a very worth willed project. Mr. Spagnuolo questioned if the building had already been <br />approved. Mr. Conway indicated that the building is before the Planning Commission for the very first <br />tiine tonight. The only purpose of this proposal being before this board tonight is so that this board can <br />make a recommendation to the Board of Zoning Appeals as to whether or not they feel the variance <br />should be granted. The Board of Zoning Appeals is an independent body and will make their decision <br />based solely on their own decision. Prior to 1991, all proposals went directly to the Board of Zoning <br />Appeals if variances were required. In 1991, Planning Commission voiced an opinion that all proposals <br />should first go before them so they can make a recommendation. The development of the building will <br />not start until June 12, 2001. Mr. Spagnuolo agreed that the homeowners should meet with NOGA <br />fir•st as they a.re part of the golf course and what they do effects the homeowners. Mr. Allan indicated <br />that he felt that he was missina something it seemed that the homeowners present were discussing <br />golfing whole issues, clubhouse issues, office building, or museum issue and asked for clarification. <br />Mrs. Spalding indicated that green space is green space and by design, the golf course has been set in <br />stone that it is a green space for the condominiums. The Association does not know what the feelings <br />are of the homeowners as they have not met with them. There are issues as to who is going to pay for <br />the damage to the roads from the construction trucks that will be usina the entranceway. Mr. Hreha <br />- reviewed that like Top's Market who addressed the neighbors issues in between Planning Commission <br />meetings. This proposal has the same opportunity to do the same as the proposal will return to the <br />Planning Commission. The process needs to start in motion and the developer needs to work with the <br />association. Mr. Spagnuolo indicated that the association has issues as they are attached to the aolf <br />course and as such, they would like to be in the loop when decisions are made. Mrs. O'Rourke <br />questioned who owned the golf course. Mr. Spagnuolo indicated that the golf course was given to <br />NOGA. Mrs. O'Rourke questioned who maintained that golf course. Mr. Spagnuolo answered NOGA <br />maintains the golf course. Mrs. O'Rourke believed that the association should meet with the developer <br />right away, so that everyone could have a better understanding as to what is taking place. Mr. Conway <br />8
