2). Ronald and Catherine Pickett23559 Alexander Rd.: (WRD-2) <br />Request for variance (1123.12). The proposal consists of not building a garage. <br />The following variance is requested: <br />1. A variance for having no garage on a residential property (code requires a 1 car garage, applicant <br />shows 0). <br />Which is in violation of Ord. 90-125 section-(1161.08 (a)(1)). <br />Vice Chairman Kremzar called all interested parties forward to review the request. Mr. and Mrs. <br />Pickett came forward to be sworn in. Mr. Bob Carney, a neighbor, came forward as well. Mr. <br />Kremzar asked if there is a reason they cannot build a garage. Mrs. Pickett indicated they cannot build <br />now because of expenses. They took the garage down ]ast summer because it was unusable. It was <br />unusable when they bought their home and it got to the point where it was noticeable from the street <br />and someone called on it. They were given two weeks to either fix it or tear it down. At that point, <br />they were not told they had to put another one back up. Mr. Carney gave Mr. Kremzar a letter from a <br />resident that was not able to attend the meeting. Mr. Carney pointed out that he lives across the street <br />and he is against the variance being granted. Mr. Kremzar asked how long it would take before the <br />Pickett's could build a garage. Mr. Pickett said it would be 4 or 5 years. Mr. Kelly said that is quite a <br />long time. He added that even though they didn't realize they would have to replace it, it is part of the <br />code to have one. Mrs. Sergi asked what the applicants plan to do with the area where the garage was <br />located. Mrs. Pickett said they have to clean that area. The foundation is still there and they will clean <br />that up and they would like to put up a shed at the back of the yard to store children's toys. Mr. <br />Kremzar asked Mr. O'Malley if a carport would be acceptable. W. O'Malley said he does not believe <br />so. 1Vir. Conway pointed out the code calls for an enclosed garage. Mr. Kremzar inquired about <br />imposing a time limit. Mr. O'Malley indicated the board can impose restrictions or conditions upon a <br />variance. 1VIr. Kremzar asked Mr. Carney if 6 months to a year would be acceptable in terms of <br />rebuilding. Mr. Carney asked what kind of comrnitment the board could get from the applicant. Mr. <br />Kelly said he believes a year is ample time and they can use savings by putting up a teinporary <br />structure for a new garage. Mr. Pickett said he will be out of work for three months this year. Mr. <br />Kremzar pointed out if they amend the variance to one year it will take three votes either way. Mr. <br />O'Malley confirmed it would be up to the board to make the variance conditional. Mr. Kremzar said <br />he would like to limit it to one year. Mrs. 5ergi asked Mr. Carney if he and other neighbors would be <br />comfortable with that. Mr. Carney said the negative effects on the value of his home are a concern. <br />Mr. Kremzar asked if there is any concern about the condition of the property itsel£ Mrs. Sergi said it <br />would all have to be cleaned out. It isn't safe, especially with having children. Mr. Pickett said they <br />are doing that a little at a time. Mr. O'Malley indicated he would not recommend making property <br />maintenance issues a condition of the variance. Mr. Carney asked about the size of the shed. Mr. <br />Kremzar pointed out that what is before them is the issue of the garage. Mr. O'Malley said if a <br />homeowner elects to build a shed within the confines of the code, there is nothing more to say about it. <br />They would come before the board again if they chose to build a shed that was at a variance from what <br />the code allows. Mrs. Pickett pointed out the shed they are proposing would be 6x10 and is within <br />code. 5he indicated it is on the plans they submitted. Mr. Kremzar asked for confirmation that if the <br />board denied the variance, the applicant would be forced to build the garage now. Mr. O'Malley said _ <br />the code would then be enforced. Mr. Kelly indicated he could go along with a provision that said they <br />have one year to build a garage. <br />W. Kremzar motioned to grant Ronald and Catherine Pickett, 23559 Alexander Rd., their request for <br />variance (1123.12), which consists of not building a garage, and that the following variance be granted <br />as amended: <br />l.
