S Allen Deak4703 Bailey Rd.; (WRD-41 <br />Request for variance (1123.12). The proposal consists of a new garage. <br />The followirig variance is requested: <br />1. A 4 foot variance for rear yard (code requires 10 ft., applicant shows 6 ft.). <br />Note: New garage is replacing a single car garage that is in the same place with the same side and rear <br />yard dimensions. <br />Which is in violation of Ord: 90-125 section (1135.02(c)(2)). <br />Vice Chairman Kremzar called all interested parties forward to review the request. Mr. S. Allen Deak <br />came forward to be sworn in. Mr. Deak indicated his mother lives in the house and the current garage <br />is not in good shape. He said the way the garage will be situated, if it is moved 4 ft. closer, it would <br />interfere with a gas grill and become a safety issue. He does not see how getting that much closer to <br />house would work, especially with larger vehicles. Mr. Kremzar asked about the dimensions of the old <br />and new pads. Mr.. Deak and board members.reviewed the plans and discussed dimensions. Mrs. <br />Sergi asked about the location of a wall. Mr. Deak indicated it would get about 6 ft. wider. W. Deak <br />said it will now be a 2 1/2 car garage. They discussed the drawing further and got clarification on the <br />figures they were given. Mrs. Sergi asked why he is going from a one-car garage to a 2-car garage. <br />Mr. Deak indicated he needs to replace the old one and the house would be more sellable with a large <br />garage. Mr. Kelly said the lot is, not very deep at 147 and he can see the reason for keeping it back <br />further in order to get access to it. <br />N. Sergi motioned to grant S. Allen Deak, 4703 Bailey Rd., his request for variance (1123.12), which <br />consists of a new garage, and that the following. variance be granted: <br />1. A 4 foot variance for rear yard (code requires 10 ft., applicant shows 6 ft.). The proposal consists of replacing old shed with a new and larger <br />shed. <br />The following variances are requested: <br />1. An 8 foot variance for erecting a shed closer to rear property line than ordinance permits (code <br />requires 10', applicant shows 2'}, section (1135.02 (d)(4)). <br />2. A 43 syuare foot variance for a shed larger than 2% of rear yard area (code permits 53 square ft., <br />applicant shows 96 square ft.), section (1135.02 (d)(1)). <br />Note: New shed will replace old smaller shed. Required 10' from rear line fence will put shed in <br />middle of yard. <br />Which is in violation of Ord. 90-125 section (1135.02 (d)(4)), and (1135.02 (d)(1)). <br />Vice Chairman Kremzar called all interested parties forward to review the request. Clay and Diana <br />Lindsey came forward to be sworn in. Mr. Lindsey indicated they have a 6x6 storage shed in their <br />backyard and they want to replace it with a new shed at 8x12. They would like the new shed 2-ft. off <br />of the back property line. There is nothing back there now except thicket. They have a 6-ft. privacy <br />fence all across the back and if they were to put the shed 10-ft. out from the back line, it would be like <br />walking out of the garage and right into the shed. W. Kremzar mentioned there are overhead wires <br />back there and an easement. Mrs. Lindsey indicated it is just about even with the fence. She added the <br />shed they are looking at is sloped toward the back. They reviewed the plans. Mr. Kremzar asked if <br />there is a swell in the back or drainage. Mr. Lindsey said there is nothing back there. Mrs. Sergi asked
