Mr. Lindsey said it will come out another 2 ft. and 4 ft. over. Mrs. <br />Lindsey said they have an attached garage and have to keep combustible material in there because they <br />have no other means of storage, which is not safe. Mr. Kremzar asked what would happen if the <br />electrical wires came down. Mr. Kelly said he is concerned about that as well. He said 2 ft. is too <br />olose to any type of utility and accessibility. He said they would need a minimum of 4-6 ft. Mrs. Sergi <br />asked if they would consider moving it into the 22 ft. and move it back out from the fence further, 5 ft. <br />from the fence, but further from the house. Mrs. L,indsey said it is narrower there. The depth they are <br />talking about is behind the garage. Mrs. Sergi asked if their goal is to preserve more of their yard. <br />Mrs. Lindsey indicated that is correct, and added that the yard is only 25 ft. deep. Mrs. Sergi said if <br />they move the shed more toward the corner, they would still have a large part of yard. They reviewed <br />the plans further. The board and applicants negotiated moving the shed a bit. Mr. Kremzar reminded <br />them of the need for 3 votes. He asked if moving the shed 5-ft. off of each property line would be <br />acceptable. <br />W. Kremzar made a motion to grant Clay Lindsey, 4555 Ranchview Dr., the request for variance, <br />(1123.12), which consists of replacing old shed with a new and larger shed, and that the variances be <br />granted as amended: <br />1). A 5 ft. variance for erecting a shed closer to the rear property line than ordinance permits (code <br />requires 10', applicant shows 5'), section (1135.02 (d)(4)). The shed to be moved to the left rear corner <br />5 ft. in from the side and back. <br />2). A 43 square foot variance for a shed larger than 2% of rear yard area (code permits 53 square ft., <br />applicant shows 96 square ft.), section (1135.02 (d)(1)). Note: New shed will replace old smaller shed. <br />Required 10' from rear line fence will put shed in middle of yard. The proposal consists of addition to house. <br />The following variances are requested: <br />A special permit to add to a non-conforming building (1165.02) <br />Note: With existing sunroom (10 x 15) dwelling is only 40 feet from rear line now. <br />1. A 15 foot variance for a residential dwelling too close to rear property line (code requires 50 ft., <br />applicant shows 35 ft.), section (1135.08 (a)). <br />Which is in violation of Ord. 90-125 section (1165.02), (1135.08 (a)). This request has been tabled at the request of the applicant until the next Board of Zoning Appeals <br />meeting on July 10, 2002. <br />6). Gerald Wisniewski; 5560 Columbia Rd.; (WRD-4) <br />Request for variance (1123.12). The proposal consists of building a gazebo in rear yard on existing <br />pool deck. The following variance is requested: _ <br />1. A 4 foot, 3 and 3/4 inch variance for an accessory building higher than code permits (code permits <br />12 ft., applicant shows 16 ft, 3 and 3/4 inches). <br />Note: Existing pool deck is 2'2" above grade. <br />Which is in violation of Ord. 90-125 section (1135.02 (d)(3)). <br />Vice Chairman Kremzar called all interested parties forward to Teview the request. Mr. Gerald <br />Wisniewski came forward to be sworn in. He indicated they are putting a gazebo on an existing deck. <br />It will need a height variance. They referred to the drawings. Mr. Wisniewski confirmed the figures <br />given to the board. <br />4
