T. Kelly made a motion to grant Gerald Wisniewski, 5560 Columbia Rd., his request for variance
(1123.12), which consists of building a gazebo in rear yard on existing pool deck, and that the
following variance be granted:
1. A 4 foot, 3 and 3/4 inch variance for an accessory building higher than code permits (code permits
12 ft., applicant shows 16 ft, 3 and 3/4 inches). Note: Existing pool deck is 2'2" above grade. Which
is in violation of Ord. 90-125 section (1135.02 (d)(3)). The motion was seconded by N. Sergi and
unanimously approved. Variance Granted.
7). Robert Grant5704 Bradle Ry__ d._(WRD-3)
Request for variance (1123.12). The proposal consists of an addition to rear of house.
The following variance is requested:
1. A 7 foot variance for a detached garage closer to the dwelling than-code permits (code permits 15
ft., applicant shows 8 ft.).
Which is in violation of Ord. 90-125 section (1135.02 (c)(2)).
Vice Chairman Kremzar called all interested parties forward to review the request. Robert and Jerilyn
Grant came forward to be sworn in. Mr. Grant indicated they would like an addition on the back of
their house. It would be 8 ft. from the garage and would be 26x16. Mr. Kremzar inquired about fire
proofing. He said there must be 15 ft, between a garage and an addition if there is no fire proofing.
Mr. Grant asked what is necessary for fire proofing. Mr. Conway indicated they would have to dry
wall the inside of the garage. Mrs. Grant asked for confirmation that the part of the garage that is less
than 15 ft. from the house needs to be dry walled. Mr. Conway confirmed that and said it would have
to be a condition of the variance. Mrs. Sergi asked if the Grants have any concerns about the distance.
They indicated they do not as they have a large yard. Mr. Kremzar asked why they need the addition.
Mrs. Grant replied it will be used for a family room and a second bathroom. Mr. Kremzar confirmed
with Mr. Conway that the garage will need to be dry walled within 15 ft. of the structure. Mr. Conway
suggested that they indicate the applicant must fire rate the wall and the ceiling within 15 ft. of the
addition.
W.
