Mrs. Sergi expressed <br />concern about the bushes along the back. She asked if the fence will be on the inside of the bushes. <br />Ms. Summer indicated that was correct and pointed out the bushes belong to a neighbor. Mrs. Sergi <br />asked if the neighbors were consulted. Ms. Summer indicated she spoke with both neighbors and no <br />one has a problem. T. Kelly made a motion to grant Andrea Summer, 28108 Angela Dr., the request for variance <br />(1123.12), which consists of erecting a fence on a side lot, and that the following variance be granted: <br />1. A 30 foot variance for erecting a fence within required 50 ft. front setback of an abutting lot on a <br />side street (code permits 0, applicant shows 30 ft.). Note: Proposed fence will be a 4-ft. high chain link <br />fence. Which is in violation of Ord. 90-125 section (1135.02 (f)(2)). The motion was seconded by W. <br />Kremzar and unanimously approved. The proposal consists of installing a swimming pool in the rear yard. <br />The following variances are requested: <br />1. A 46 square foot variance for swimming pool (code requires 130 square ft., applicant shows 176 <br />square ft.), section (1135.02 (d)(2)). <br />2. A 6 inch variance for side yard (code requires 5 ft., applicant shows 4 ft., 6 inches), section <br />(1135.02 (i)). <br />Which is in violation of Ord. 90-125 section (1135.02 (d)(2)), and (1135.02 (i)). <br />Vice Chairinan Kremzar called all interested parties forward to review the request. Mr. Wensink came <br />forward to be sworn in. Mrs. Mary Comodeca, also came forward to be sworn in. She was <br />representing her son, a neighbor to Mr. Wensink. Mr. Wensink indicated they would like a pool in <br />their yard and they have selected the smallest one available. Mrs. Comodeca said she is worried about <br />water. She lives in a slab house that is owned by her son. Mr. Kremar asked how the pool would be <br />drained. Mr. Wensink said he would drain the pool into the sewer. He said he did not have a cover <br />last year and he dumped water behind his garage. Mrs. Comodeca explained that water from the pool <br />has flooded her yard in the past. Mr. Wensink indicated he will now run water to the sewer. Mr. <br />Kremzar asked if he could get a smaller pool. Mr. Wensink repiied that 15 ft. is the smallest he could <br />get. Mr. Kremzar said he is concerned as to why he can't move it 6 inches over toward the garage. Mr. <br />Wensink indicated he could do that. IVIr. Kremzar pointed out that it would take care of one variance. <br />W. Kremzar made a motion to grant Don Wensink, 4752 Fleharty Rd., his request for variance <br />(1123.12), which consists of installing a swimining pool in the rear yard, and that the following <br />variance be granted as amended: <br />1.
