Vento disagreed because of the view from her <br />property. Mr. Maloney reminded the board that the deck is not an issue. N. Sergi made a motion to grant Bernie Romano of 3896 Walter Rd. her request for variance (1123.12), <br />which consists of an addition to her home and that the following variances be granted: <br />A special permit to add to a non-conforming building (1165.02 (b)). <br />Note: Existing building has a 16.5 ft. side yard setback, code requires 25 ft. <br />1. A 4 foot variance for side yard setback (code requires 25 ft, applicant shows 21 ft). <br />Which is in violation of Ord. 90-125 section (1135.06 (b)). Note: This request was tabled at the July 10, <br />2002 meeting. The motion was seconded by J. Konold and unanimously approved. Variances <br />Granted. <br />3. Phil Mertz; 4537 Gladland (WRD-4) <br />Request for variance (1123.12). The proposal consists of a shed. <br />The following variances are requested: <br />1. A 5 foot variance for rear yard setback (code requires 10 ft., applicant shows 5 ft.), section (1135.02 <br />(d)(4)) • <br />2. A 120 square foot variance for shed larger than allowed (code permits 200 sq.. ft, applicant shows <br />320 sq. ft), section (1135.02 (d)(1)). Which is in violation of Ord. 90-125 sections (1135.02 (d)(4)), and (1135.02 (d)(1)). <br />Note: This request was tabled at the July 10, 2002 meeting. <br />Chairman Maloney called all interested parties forward to review the request. Phil.Mertz came forward <br />to be sworn in. Mr. Mertz explained he currently has 2 existing structures that are in bad shape. He <br />showed pictures to the board members. He would like to remove those 2 structures and put up a new <br />shed, which would improve the quality of his property. Mr. Maloney asked if he could go smaller than <br />16x20. Mr. Mertz indicated he could not and mentioned he had spoken with his neighbors. He <br />contacted the neighbors listed on the legal notice and obtained signatures indicating there is no <br />objection. He said the square footage would be smaller than what he has now and he would like to open <br />up the yard. Mr. Konold mentioned the board cannot go by what the neighbors say. They must go by <br />the code. Mr. Mertz indicated he understands that. Mrs. Sergi asked if he has a basement. He iridicated <br />he does. Mr. Kremzar asked if there is a reason he has to be 5 ft. back. Mr. Mertz indicated he is <br />willing to change that. He does not have anyone directly behind him. Mr. Kremzar said if he could <br />bring it forward, it would do away with one variance. Mr. Maloney said they would only need variance <br />number two (2). <br />W. Kremar made a motion to grant Phil Mertz of 4537 Gladland, his request for variance (1123.12), <br />which consists of a shed and that the following variance be granted as amended: <br />The shed will be placed 10 ft. from the rear setback which eliminates the first request listed above. <br />1. A 120 square foot variance for shed larger than allowed (code permits 200 sq. ft, applicant shows <br />320 sq. ft), section (1135.02 (d)(1)). <br />Which is in violation of Ord. 90-125 sections (1135.02 (d)(4)), and (1135.02 (d)(1)). <br />Note: This request was tabled at the July 10, 2002 meeting.
