, established is an issue. He does not want to look through his living room window and see an open
garage. Mr. Budny never saw any plans and he wants to make sure it will fit in. Mr. Maloney referred
to the plans and pointed out the resident would be 39.01 ft. to the front of the garage so the front line of
the street will be maintained. Mrs. Serai asked if the new driveway will be straight. Mr. Lusardo
indicated it will be straight. Mr. Konold commented a new house will enhance the area.
J. Konold made a motion to grant David Lusardo of 23186 Sumriierland his request for variance
(1123.12), which consists of building a home and that the following variance be granted:
1. An 11 foot variance for front yard setback (code requires 50 ft., applicant shows 39 ft.)
Which is in violation of Ord. 90-125 section (1135.06 (a)). The motion was seconded by N. Sergi and
unanimously approved. Variance Granted.
9. Bill and Cherie Sabol4159 Root Rd. ()YRI)-1)
Request for variance (1123.12). The proposal consists of an addition to existing dwelling.
The following variances are requested:
1. A 4 foot variance for side yard setback (code requires 15 ft., applicant shows 11 ft.)
2. A 5 foot variance for less than minimum side yard requirements (code requires 15 ft., applicant
shows 10 ft.)
Which is in violation of Ord. 90-125 sections (1135.07 (a)).
Chairman Maloney called all interested parties forward to review the request. Cherie and Bill Sabol,
contractor David Macartney, and neighbor Ed Zetts, came forward to be sworn in. Mrs. Sabol
indicated they would like to put on an addition. It will be a two car garage. She pointed out they
currently have a single detached garage that would be torn down. The variance is needed because they
want to go 16 ft. out and attach the garage, which only allows them 5 ft. on each side of the lot. Mr.
Conway pointed out that the write up on this proposal was miswritten. He said the varianc.e should be
for distance between dwellings and it will have to be amended. Instead of a sideyard setback, it will be
for 15 ft. between dwellings. Mr. Zetts asked if that means the addition will be 11 ft. from his house.
Mr. 1Vlaloney referred to the plans and pointed out he would be 12 ft. from the edge of their garage.
Mrs. Sergi pointed out Mr. Zetts' house isn't right next to the garage. It is up further by the Sabol
house. There was further discussion about how far apart the homes would be. Mr. Maloney said there
would have to be a firewall on the side of the garage because they are adjacent to their own dwelling.
Mr. Zetts asked for clarification on the second variance request. Mr. Maloney explained that from the
Sabol property line they need a total of 15 ft. Mrs. Serai asked if Mr. Zetts had any problems with it.
Mr. Zetts replied he did not. .
J.
