Chairinan Maloney called all interested parties forward to review the request. Michelle Gricar came <br />forward to be sworn in. Ms: Gricar indicated she would.like to build a shed and one corner of the barn <br />would be closer to the back property line than allowed. She said it will look nicer in that spot and it <br />would be angled toward the house for easier access. She mentioned that neighbors behind her and on <br />the side have barns in that corner. Mr. Kremzar asked for the size of the shed. Ms: Gricar said it will <br />be 10 x 12 or possibly 12 x 12. She mentioned she has plenty of room in the yard. Mr. Konold <br />concurred. <br />J. Konold made a motion to grant Michelle Gricar of 24713 Gessner Rd. the request for variance <br />(1123.12), which consists of a shed and that the following variance be granted: . 1. A 4 foot variance for rear yard setback (code requires 10 ft., applicant shows 6 ft.). <br />Which is in violation of Ord. 90-125 sections (1135:02 (d)(4)). The motion was seconded by N. Sergi <br />and unanimously approved. Variance Granted. <br />11. So L. Litten; 24789 Deerfield Dr. ()YRID-2) Request for variance (1123.12). The proposal consists of an addition to home. <br />The following variances are requested: <br />A special permit to add to a non-conforming building (1165.02) <br />Existing home is only 27 feet from rear property line. <br />l.. A 38 foot variance for rear yard setback (code requires 50 ft., applicant shows 12 ft.). <br />Note: Work has been started on addition. F'ooter has been poured as of 7/17/02. <br />Which is in violation of Ord. 90-125 sections (1165:02), and (1135.08 (a)). <br />Chairman Maloney called all interested parties forward to review the request. Ms. So Litten, her co- <br />worker Dan Newman, and neighbors Annette Cox, Colleen Steidel, and Lynn and 1Vlike Bycko, came <br />forward to be sworn in. Ms. Litten said she would like to put in an enclosed porch. Mr. Maloney <br />confirmed that she wants to add a room 15 ft. out from her present house and it would give her 12 ft. <br />from the rear yard. He pointed out that the code requires 50 ft. . He said she is already 27 ft. out from <br />the rear of the house. Mrs. Cox mentioned that she lives directly behind the Litten's and it is already <br />close. She said she would agree to it if the Litten's put up a 6 ft. privacy fence before the construction <br />starts. Mrs. Steidel said her yard backs up to the Litten's yard. She would also like to see a 6 ft. fence <br />because there is already a shed there and with the addition, they would practically be in her yard. Mr. <br />Maloney mentioned the plans did not show the shed and they saw it when the reviewed the site. Ms. <br />Litten pointed out they have a fence currently surrounding the yard. She said she does not have a <br />problem with putting up a 6 ft. privacy fence. Mrs. Bycko indicated they live next door and tliey have <br />no problem with the variance if a 6 ft. fence is put up. Mr. Bycko added they abut the property where <br />the shed is located. Mrs. Sergi asked why the applicant wants to put the room on. Ms. Litten indicated <br />it is for the safety of her children. She wants to be able to see her children playing in the yard. Mr. <br />Maloney said he wondered why she could not put the addition on the side of her house where she has <br />24 ft., instead of cutting the backyard down to only 12 ft. He said he has a problem with coming out <br />from the house and cutting the backyard down so small. Ms. Litten indicated she has a door off of the <br />dining room already so she would like the addition put there. She does not want to have to cut into <br />another wall. Mr. Newman mentioned Ms. Litten wants to do this for her children. He added that she <br />spoke to the neighbors before the meeting and she is more than willing to put up a 6 ft. privacy fence. <br />He said she has an odd shaped lot and there is not much space even without the addition. Mrs. Cox <br />said there is already a fence that goes along 3 yards. She asked if a privacy fence would but up against <br />that fence. Mr. Conway confirmed the old fence would have to come down because two fences cannot <br />run parallel to each other. It was brought up that the footers were already poured. Mr. Maloney <br />mentioned the letter from Mr. Cifranic, a city inspector, who explained the variance for the rear yard <br />and the footers. Mr. Cifranic pointed out that the patio could remain just a patio with footers and she <br />could take a chance on the variance.
