CTTY OF NOIaTH OLMSTED <br />"TOGETHER WE CAN MAKE A DIFFERENCE", <br />BOARD OF ZONING APPEALS <br />MIlNU'1'ES - JULY 10, 2002 <br />I. ROLL CALL: Chairman, Maloney called the meeting to order at 7:30 p.m. <br />PRESENT: Chairman, Maloney, Board Members W. Kremzar, and T. Kelly. <br />ABSENT: Board Members J. Konold and N. Sergi. <br />ALSO PRESENT: Assistant Law Director, B. O'Malley, Building Commissioner T. Rymarczyk and <br />Clerk of Commissions, D. Rote. <br />II. REVIEW AND CORRECTION OF MINUTES: The Board of Zoning Appeals minutes of June 6, <br />2002 have been submitted for review. <br />W. Kremzar motioned to approve June 6, 2002 minutes as submitted. T. Kelly seconded the motion, <br />which was unanimously approved. <br />Chairman Maloney reviewed that there were 17 cases requesting 43 variances and 1 special permit. <br />Mr. Maloney pointed out that request number one (1) on the agenda is tabled at the applicant's request <br />and request number 19 is withdrawn as Planning Commission tabled the proposal. Soth requests wil] <br />be addressed at the August meeting. The Chairman further advised that each board member had <br />viewed the premises involved for each case. Three votes are required for approval. In addition each <br />case will be judged on the physical situation peculiar to itself, so that in no way is a judgment <br />rendered considered to be a general policy judgment affecting properties and like situations <br />elsewhere. He pointed out that only three members were present. Therefore, each applicant has the <br />choice to postpone his or her request until the next full meeting. He questioned if any applicant <br />wished to be postponed until the next •regularly scheduled meeting. <br />III. The proposal consists of addition to house. <br />The following variances are requested: <br />Note: With existing sunroom, (10 x 15) dwelling is only 40 feet from rear line now. <br />1. A 15 foot variance for a residential dwelling too close to rear property line (code requires 50 ft., <br />applicant shows 35 ft.), section (1135.08 (a)). <br />Which is in violation of Ord. 90-125 sections (1165.02), (1135.08 (a)). Tim and Bernadette Campbell• 29760 Westminster• (`iYItD-3) <br />Request for variance (1123.12). The proposal consists of erecting a new shed. <br />The following variance is requested: <br />1. An 86 square foot variance for a shed larger than code permits (code permits 130 sq. ft, applicant <br />shows 216 sq. ft). <br />Note: If approved, applicant must show correct 18x12 dimensions on permit application. In addition, <br />an electrical permit must be applied for before installing electricity to shed. <br />Which is in violation of Ord. 90-125 section (1135.02 (d)(1)). <br />Chairman Maloney called all interested parties forward to review the request.
