,' • , <br />came forward to be sworn in and address the request. Mr. Campbell would like to have a 216 square <br />foot shed, which will be 18' x 12' to store tools and have an area for his hobby. The shed will be <br />placed in the rear northwest corner of the backyard. It will be 11-feet off the rear property line and 6- <br />feet in from the west side property line. The existing 10 x 10 shed will be removed. Mr. Sexton <br />indicated that he would be reading a letter from Mr. Campbell's neighbors opposing the shed (See <br />said letter attached to back of these minutes). The neighbors are concerned about the amount of <br />noise, size of shed, increase in traff'ic and that the shed will be used as a business. Neighbors wish the <br />board to uphold the code and not allow the variance requested. Mr. Sexton remarked that the codes <br />were designed to protect homeowners/neighbors from things such as this. He further, commented <br />that everyone present is against the variance. Mr. Hewitt indicated that he would read his letter <br />opposing the shed (see said letter attached to back of these minutes). Mr. Hewitt is Mr. Campbell's <br />rear abutting neighbor. He indicated that he is hesitant to speak against the variance being requested. <br />After the last meeting in which Mr. Campbell was denied a variance, the Campbell's' retaliated by <br />placing a radio in their backyard at the highest noise level all day. At the last meeting, he voiced a <br />concern about the sun blocking his vegetable garden. Within one week of the variance being denied <br />the Campbell's erected a 6-foot high fence along their rear property line which blocks the sun from <br />his vegetable garden. Mr. & Mrs. Hewitt strongly object to the variance being requested. Mr. <br />Hewitt voiced that the authors of ordinance 90-125 section covering backyard sheds set the <br />perimeters for sheds to be used as storage only, and be proportional to the lot size in which it is to be <br />built on. The Hewitt's are concerned about the amount of noise that will be inflicted upon the <br />neighbors from the wood working tools that will be used. The neighbor's do not want this shed as it <br />will only be 30 to 50 feet from the abutting neighbors. Councilman, Nashar indicated that the <br />neighbors have strongly objected to the variance request. Councilman, Nashar is present because Mr. <br />Campbell's neighbors have asked him to represent them in their plea to deny the variance requested. <br />Mr. Nashar respectfully requests that the Board of Zoning Appeals turn down the variance request. <br />Council President Thomas O'Grady indicated that he was invited to attend the meeting by the <br />Campbell's. He is present to represent all citizens of North Olmsted. This issue has become one <br />group against another which is a no win situation. Unless both parties work together to work out a <br />compromise, someone will get hurt and the caricature of the neigYiborhood will be ruined. There will <br />be hard feelings between neighbors and that benefits no one. Council President O'Grady felt that the <br />situation could benefit both sides if everyone was willing to compromise. There have been valid <br />concerns voiced such as a private business being operated from the shed. That question should be <br />addressed to the Law Department because he does not believe that the current laws allow such a <br />thing. Mr. O'Malley indicated that Mr. O'Grady was correct. Another concern was noise; there are <br />codes, which stipulate noise allowed as well as light spill-off. As Council President, he believes in <br />the codes that have been established for this City. Instead of trying to make, a winner and a loser <br />there should be a compromise. Mr. Hewitt indicated that Mr. O'Grady's comments were about two <br />months to late. Mr. & Mrs. Campbell never asked any of the neighbors about putting up their shed. <br />There is another gentleman present from the neighborhood requesting a shed and he talked to his <br />neighbors beforehand, he did not wait until the last minute. Mr. Mital indicated that he was only <br />concerned with the size of the shed. Mr. Campbell voiced that he would like to address some of the <br />concerns. He does wood working when he has free time, and currently has a 10 x 10 shed, which is <br />not large enough to store his tools. He is only asking for an additional 8-feet as the shed will be 18 x <br />12. He does not feel that blocking the sun is an issue as there are currently many trees in Mr. <br />Hewitt's yard now shading the backyard. Mr. Campbell commented that he would not be reckless in <br />the use of his tools and would not disturb the neighbors. . Mrs. Campbell suggested that the tools that <br />are used are no louder then a lawn mower. They have never run the tools late at night, they both <br />work full time and have children to deal with. There have only been two projects built in the 10 <br />months that they have lived in their home. There was a cradle and now they are working on a jewelry <br />box, the free time to work on their hobbies is very limited. They have reduced the size of the shed by <br />2
