19. Pepper Joe's Restaurant24532 Lorain Rd.; (WRD-2) <br />Request for variance (1123.12). The proposal consists of a new restaurant in an existing building and <br />new sign package for building. <br />The following variances are requested: <br />1. A variance for 8 car parking (code requires 53, applicant shows 45), section <br />(1161.05 (r)). <br />2. A 2 foot variance for east side yard setback (code requires 10 ft., applicant shows 8 ft.), section <br />(1139.07) <br />Note: 1. Above items, #1 and 42 are pending lot consolidation. <br />2. Above items #1 and #2 are also pending the rear parking area being paved, Iined and <br />curbed with retention as required by the Engineering Department. <br />3. Christopher Smith• 3857 Woodpark Lane;(WIiD 1) <br />Request that the board amend their motion dated May 2,2002 on request number 5. <br />To read; The following variances are granted: <br />1. A 50 foot variance for a fence within required neighbors front setback on a corner lot (code permits <br />0', applicant shows 50'), section (1135.02(fl(1)). <br />Chairman Maloney called all interested parties forward to review the request. Mr. & Mrs. Smith, the <br />owners, came forward to be sworn in and address their request. Mrs. Smith reviewed that the CEI <br />representative indicated that they would not need a 5-foot area to reach their lines only 6 inches is <br />required. CEI wrote a letter to the Smith's stating that they do not require 5-feet to reach the electrical <br />lines located on their lot. Therefore, she would like the board to amend the motion to allow the fence to <br />be placed 6-inches from the rear property line. <br />J. Maloney motioned to grant Christopher Smith of 3857 Woodpark Lane his request for the board to <br />amend their motion dated May 2,2002 so that the following variance is granted: <br />A 49-foot 6-inch variance for a fence within required neighbors front setback on a corner lot (code <br />permits 0', applicant shows 6-inches'). Which is in violation of Ord. 90-125 section (1135.02(fl(1)). The <br />motion was seconded by W. Kremzar and unanimously approved. Varianee tGranted. <br />IV. NEW BUSINESS: <br />V.
