<br />11. A variance to install a three dimensional illuminated red band on gas island canopy (code does not <br />permit, applicant shows one), section (1163.25). <br />Note: 1. Existing road sign to be removed due to widening of Clague Rd. <br />2. Canopy and building signage pending minor change approval for building modification. <br />Which :is in violation of Ord. 90-125 section (1163.26 (a)), (1163.26 (b)), (1163.26 (c)), (1163.24 (a)), <br />(1163,27 (c)), (1163.27 (b)), (1163.28 (a)), (1163.25). <br />Chairman Maloney called all interested parties forward to review the request. Mr. Don Reiman, attorney <br />for Shell, and Tim Flury and Johif Dzwonczyk of JGD Associates, came forward to be sworn in and address <br />the board. Mr. Reiman explained the widening of Clague Rd. will result in the removal of the existing Shell <br />sign at the; intersection of Clague and Lorain. The road widening is the driving force behind their request <br />£or varianc;es. He indicated Mr. Flury and Mr. Dzwonczyk have put together plans that will show where the <br />sign variatices can be found. They are asking for a ground sign along Clague and a pole sign that has to be <br />on the op;posite side of a bus shelter. The only way someone would be able to see it going east along <br />Lorain would be if it were higher than code permits. Mr. Dzwonczyk asked if the board would prefer each <br />item to be handled separately or handled as a group. Mr. Maloney suggested handling requests one through <br />seven (#1-•7) first. Mr. Rymarczyk pointed out that one more variance was added. It is for a ground sign <br />being in a 35' triangle. Mr. Dzwonczyk started with the first request (#1), for an additional ground sign. <br />He said they are surrounded on both interior sides by CVS Pharmacy. He said CVS has two signs; there is <br />one on C:lague and one on Lorain. He referred to the photographs and showed the board what their <br />proposed signs would look like. Mr. Kremzar asked if the Shell sign would be closer to CVS property. <br />Mr. Dzwonczyk said it will be and again referred to the plans. He said they are asking for something that is <br />similar to what has 6een done with the two signs. With regard to the second request (#2), he said if they <br />were to bel ZO' as required, the sign would be in the driving area of the entrance to the station. They are <br />already losing area with the changes to the property. Mr. Kremzar asked if the height of the sign will block <br />vision of people turning onto Lorain. Mr. Dzwonczyk said it will not. He said the third request (#3) is <br />similar. H:e explained that with the driveway and the other work .they have to do to make it all fit with the <br />road widemng, they feel it is an appropriate location. There was further discussion and review of the plans. <br />Mr. Rymarczyk clarified some of the figures in the request. Mr. Dzwonczyk indicated they have existing <br />parking arid a rubbish enclosure which would be impacted by moving the sign closer in to the building. <br />They havf; to take their vent lines that would be in the proposed right of way and move them to an <br />appropriate place. They would want to hide them more behind the sign so that is what they are proposing, <br />as opposed to putting them on the street side of the sign. He referred to the original .photo and said even <br />though thf;re is a slight variance being asked for, he believes it should not impact the view in any way. The <br />fourth request (#4) deals with the proximity to the CVS property. Instead of being 20' (as in variance #2) <br />they are asking for 3' and that is due to the driveway location. The fact that they cannot use the corner <br />makes it necessary to identify them on both streets. He said a 9' variance for a ground sign pole higher than <br />permitted on Lorain Rd. is needed due to the bus shelter that is on their property (request #5). Mr. <br />Dzwonczyk said it is the least that they can do to ensure the sign is visible. He pointed out that what they <br />are asking for is not much different than what BP has on its property. The sixth request (#6) is for a 30.5 <br />square foot variance for a ground sign with larger square feet of sign than permitted. There was some <br />discussion about what sign requests go with what variance requests. Mr. Rymarczyk reviewed the plans <br />and indicated the sixth request is for the grounci sign only, on Lorain Rd. Mr. Dzwonczyk indicated they <br />are asking for that in light of the need to compete with their neighbors at BP and 5unoco. The seventh <br />request (#7) is for the entire signage on the lot facing Lorain Rd. He said they are asking for something <br />that, again, is very similar to what BP has. Mr. Rymarczyk asked for clarification on the red color band. <br />He asked :if it will be illuminated. Mr. Dzwonczyk said they intend to illuminate it. Mr. Rymarczyk said it <br />will need t.o be approved through minor change format and they will need an answer in writing as to how it <br />will be. Mr. Dzwonczyk said they had submitted a letter to Mr. Conway. Mr. Konold asked about the <br />7
