Chairman Maloney called all interested parties forward to review the request. Mr. Brian Zergott came <br />forward, along with his neighbors, Mr. Piotrowski and Mr. Chinchilla, to be sworn in. Mr. Zergott <br />explained they want to take down a structure that is in poor condition. He then referred to the photos he <br />submitted. They want to remove a crumbling wooden structure that is between Debbie D's Bar and the <br />garden ceiiter. Mr. Piotrowski asked for confirmation on the location of the structure. Mrs. Sergi pointed <br />out to the neighbors where the current structure is and asked Mr. Zergott for confirmation that it is where <br />the new structure would be erected. There was further discussion on the location of the structure and the <br />surroundirig area. Mr. Piotrowski and Mr. Chinchilla looked over the photos. Mr. Piotrowski indicated he <br />has proble:ms with water coming from the Zergott property. Mr. Maloney indicated the board cannot <br />address th.ose issues. Mr. Zergott added that the Engineering Department is trying to come up with a <br />program to address that. Mr. Zergott brought out plans and said he would like the board to be aware of <br />where everything is going to be. He explained the structure is an open air house but when weather gets <br />bad, tarps come down to close it up. The board reviewed the plans and photos. Mr. Kremzar asked if the <br />posts would be on his property. Mr. Zergott indicated they will be inside his property line. Mr. Maloney <br />asked if hE; would have drainage coming off there to control the water. Mr. Zergott said that was correct. <br />Mr. Kelly asked about the material being used for the covering. Mr. Zergott explained they will use a <br />heavier ca.nvas on the back. Mrs. Sergi asked if that is away from the Lorain Rd. side. Mr. Zergott <br />indicated t.hat is correct. He added the front will have a different material and sliding doors so people can <br />enter. Nothing will face Lorain Rd, He said they also have 18' tall pines between his business and the bar. <br />J. Konold motioned to grant Zergott Landscaping, of 29857 Lorain Rd., its request for variance (1123.12) <br />which consists of an open air structure and that the following variances be granted; 1). A 10 foot variance <br />for side y<<rd setback (code requires 10', applicant shows 0'), section (1139.07). 2). A 2 foot variance for <br />side yard ;3etback (code requires 10', applicant shows 8'), section (1139.07). Which is in violation of Ord. <br />90-125 section (1139.07). The motion was seconded by N. Sergi and unanimously approved. Vai-iances <br />Granted. <br />10. Shell; 23385 Lorain Rd.; <br />Request for variance (1123.12). The proposal consists of new signs. <br />The following variances are requested: <br />1. A variance for an additional ground sign (code pernuts 1, applicants shows 2), section (1163.26 (a)). <br />2. A 6 foot variance for ground sign too close to side lot line (Lorain Rd.) (code requires 20 feet, <br />applicant shows 14 feet), section (1163.26 (b)). <br />3. A 3 foot variance for a ground sign too close to right of way (Clague Rd.) (code requires 5 feet, <br />appGcant shows 2 feet), section (1163.26 (b)). <br />4. A 16 foot variance for a ground sign too close to side lot line (Clague Rd.) A21 inch variance for wall sign exceeding the top of surface which it is attached to (code requires <br />12 inches below, applicant shows 9 inches over), section (1163.27 (b)). <br />10.
