CITY OF NORTH OL10'ISTED <br />"TOGETHER WE CAN MAKE A DIFFERENCE" <br />BOARD OF ZONING APPEALS <br />MINUTES- MARCH 7, 2002 <br />7:30 P.M. <br />ROLL CALL: Chairman Maloney called the meeting to order at 7:30 p.m. <br />PRESENT: Chairman, J. Maloney, and Board members, W. Kremzar, T. Kelly, J. Konold and <br />N. Sergi. <br />ALSO PRESENT: Assistant Law Director, B. O'Malley, Assistant Building Commissioner, T. <br />Rymarczyk, Clerk of Commissions, D. Rote and Assistant Clerk of Commissions, A. Kilbane. <br />IL REVIEW AND CORRECTION OF NIlNUTES: The Board of Zoning Appeals minutes of February 7, <br />2002 have been subinitted for review. Mr. Konold made a motion to accept the minutes as submitted. The motion was seconded by Mr. <br />Kremzar and unanimously approved. Chairman Maloney indicated there are three cases requesting four variances and one special permit. The <br />board members have viewed the premises involved in each case. Three votes are required for approval. <br />Each case will be judged on its physical situation peculiar to itself, and in no way is any judgement <br />rendered considered to be general policy judgement affecting properties or like situations elsewhere. <br />III. BUII_,D1NG DEPARTMENT REQUESTS: <br />1. Scott ManleX; 5257 Dover Center Rd.; <br />Request for variance (1123.12). The proposal consists of garage addition. <br />The following variances are requested: <br />A special permit to add to a non-conforming building (1165.02). Note: Chairman Maloney amended the <br />request to include this permit which was omitted from the agenda. <br />1. A 141 square foot variance for exceeding allowable square footage (code permits 750 sq. ft., applicant <br />shows 891 sq. ft.) section (1135.02 (c) (1)). <br />2. A 2 foot variance for occupying area of required sidelot setback (code requires 5 ft., applicant shows 3 <br />ft) section (1135.02 (c) (2)). <br />Which is in violation of Ord. 90-125 sections: (1165.02), (1135.02 (c)(1)), and (1135.02 (c) (2)). <br />Chairman Maloney called all interested parties forward to review the request. Mr. Scott Manley, and his <br />neighbor, Mr. Joseph Tusick, came forward to be sworn in and address the request. Mr. Manley <br />explained his house and garage are about 75-80 years old. The garage is not deep enough to pull in a <br />larger pick-up truck. He would like to extend the garage out by 8'. He would re-do the front because the <br />garage door is falling off and the siding is not in good condition. He then referred to the drawings <br />submitted to the board. He went on to explain that they are looking for a better curb appearance. He said <br />there is 33' across the front so they wouldn't be aoing any further sideways. They would be going up <br />about another two feet. Mr. 1Vlanley then referred back to the drawing to show the plan to Mr. Tusick. <br />Mr. Maloney said the request will be amended to include the special permit for adding on to the non- <br />conforming building. No further comments were made. <br />Chairman Maloney made a motion to grant Scott Manley, of 5257 Dover Center Road, his request for <br />variance (1123.12).
