ROLL CALL: <br />Chairman, Maloney called the meeting to order at 7:30 p.m. <br />PRESENT: Chairman, J. Maloney, Board members, W. Kremzar, T. Kelly, J. Konold and N. Sergi. <br />ALSO PRESENT: Assistant Law Director, B. O'IVlalley, Assistant Building Commissioner, T. <br />Rymarczyk, Clerk of Commissions, D. Rote and Assistant Clerk of Corrunissions, A. Kilbane. <br />II. REVIEW AND CORRECTION OF MINUTES: The Board _of Zoning Appeals minutes of December <br />6, 2001 have been submitted for approval.. J. Konold motioned to approve the December 6, 2001 Board of Zoning Appeals minutes as <br />submitted. The motion was seconded by W. Kremzar and unanimously approved. <br />Note: Prior to the board starting their meeting, Chairman, Maloney invited Mayor Musial to come <br />forward to officially swear Nancy Baker Sergi in as a new member of the Board of Zoning Appeals <br />board. Mayor Musial called Mrs. Sergi forward and administered the oath. <br />Chairman, Maloney indicated that there are 11 cases requesting 30 variances. Mr. Maloney advised <br />that each board member had viewed the premises involved for each case. Three votes are required <br />for approval. In addition each case will be judged on the physical situation peculiar to itself, so that in <br />no way is a judgment rendered considered to be a general policy judgment affecting properties and <br />like situations elsewhere. <br />III. BUII.,DING DEPARTMENT REQLTESTS: <br />1. Carolvn Mahon: 24835 Tara Lvnn Drive: <br />Request for variance (1123.12). The proposal consists of shed already installed. <br />The Following variance is requested: <br />1. A 3 foot variance for rear yard setback (code requires 10 ft, applicant shows 7ft). <br />Note: The original proposal showed l Oft from rear and Sft from side lot line. Due to limited area of <br />small yard and a nearby drainage swell the shed was placed 3 feet farther back by the installers. <br />Which is in violation of Ord. 90-125 section (1135.02 (d) (4)). <br />Chairrnan Nlaloney called all interested parties forward to review their request. Mr. IVlahon and Mrs. <br />Mahon's stepson came forward to be sworn in and address the request. Mr. Mahon commented that <br />the shed was commissioned to be placed within the Cities Zoning Code requirements. However, the <br />installers did not feel that they could place the concrete slab in the required area due to an existing <br />draining problem. No further comments were made. <br />W. Kremzar motioned to grant Carolyn Mahon of 24835 Tara Lynn Drive her request for variance <br />(1123.12). Which consists of a shed which has already been installed and that the following variance <br />be granted; A 3 foot variance for rear yard setback (code requires 10 ft, applicant shows 7 ft). Which <br />is in violation of Ord. 90-125 section (1135.02 (d) (4)). The motion was seconded by J. Konold and <br />unanimously approved. Variance Granted. <br />2. James & Patricia Kilbourne: 5906 Columbia Road: <br />Request for variance (1123.12). The proposal consists an addition to rear of dwelling. <br />The Following variance is requested: <br />1. A 20 foot variance for rear yard setback (code requires 50 ft, applicant shows 30 ft).
