Chairman Koeth questioned if anyone had comments or remarks regarding the ordinance. Mr. <br />O'Malley suggested that the Law Director ruled to send this ordinance back to Planning <br />Commission on a technicality. He would like Planning Commission to have a defined motion to <br />either approve or deny the ordinance. Mr. O'Malley reviewed past discussions regarding <br />Planning Commissions duty to uphold the Master Plan. The Master Plan indicates this site <br />should be multiple residence. The request in this ordinance is for single family cluster, which is <br />inconsistent to the Master Plan. Mrs. O'Rourke questioned if the Assistant Law Director was <br />implying that the current ordinance was not consistent with the Master Plan. Mr. O'Malley <br />suggested that in a matter of speaking the request is consistent with a multiple residence <br />classification. This request is less dense then a multiple residence zoning. However, it is a <br />different zoning classification then the Master Plan. Some may say it is a better classification <br />then presented in the master plan. Mr. 5palding questioned if Mr. O'Malley was telling <br />Planning Commission to motion to address the master plan again. Mr. O'Malley answered <br />"No", this zoning classification is contrary to the Master Plan. Mrs. Hoff-Smith felt that the <br />ordinance was within the spirit of the Master Plan. Mr. O'Malley indicated that the Master Plan <br />controls in this instance and that a presentation of something other than that is presented by the <br />Master Plan should result in a disapproval by the Planning Commission. Board members had a <br />lengthy discussion regarding each of their opinions regarding the age of the mater plan. Their <br />role as Planning Commission being the board, which is charged with being the body to change <br />the Cities Zonings and the Master Plan. The board thanked Mr. O'Malley for his comments and <br />concerns and indicated they were ready for the motion. <br />Koeth motion to approve An ordinance providing for the amendment of the zone map of <br />the City of North Olmsted by changing the zoning of an approximately 5.5-acre vacant <br />parcel of land, known as permanent parcel number 237-19-002, located south of <br />Brookpark Road and east of Columbia Road, and the site of the proposed Rockwynd <br />Single Family Residence District to Single Family Cluster District. K. O'Rourke seconded <br />the motion, which was unanimously approved. NEW BUSINESS: <br />Review 2003 calendar of ineeting dates. <br />R. Koeth motioned to accept the meeting dates submitted for 2003 calendar year. C. Allan <br />seconded the motion, which was unaniir?ously approved. <br />Election of Chairman, Vice Chairman and Planning Commission Secretary for 2003. <br />K. O'Rourke motioned to appoint R. Koeth as Chairman, W. Spalding as Vice Chairman <br />for the 2003 calendar year. S. Hoff-Smith seconded the motion, which was unanimously <br />approved. <br />3
