Mr. Willse said the building setback is impacted and on the plan it shows it was impacted by the relocation of the <br />right of way due to the Clague Road project. On the plan in the southwestern corner he had them plot a dimension to <br />show this would have been the setback and this is how it was impacted thus increasing the amount of variance <br />required. He said regardless of what happens with that sign on Clague, chances are it will be re-worked. He has no <br />problem moving it back to be in compliance. Mr. Rymarczyk said the last variance is to put up a billboard sign where <br />they would put in a panel. Mr. Spalding asked about parking. Mr. Rymarczyk said they comply. Mrs. Hoff-Smith <br />asked for the hours of operation. Mr. Willse said 10:00 a.m. until 11:00 p.m. They are open until 12:00 a.m. on <br />Friday and Saturday during the summer. That is only at the drive through. Mr. Spalding asked about loading. Mr. <br />Willse pointed out the area just north of the store where trucks will pull around and enter. There is a ramp to the <br />northeastern corner and deliveries go in to the back of the store. They have strict guidelines with deliveries. They <br />will typically receive deliveries during non-business hours, usually 7-10:00 a.m. NIr. Rymarczyk explained the code <br />is being reworked as two of them conflict on the time deliveries can begin. Mr. Spalding inquired about the closest <br />resident to the store. He asked if the apartments are directly behind the property. Mr. Willse referred to the plan. He <br />said there is an open field and parking right behind them. He mentioned the expanded view site plan and said it gives <br />a footprint of the apartment building. Mrs. Hoff-Smith asked about the property to the south. She wondered about <br />the decibel levels. Mr. Willse said they have equipment designed to direct the sound. The speaker is set in and it <br />controls and shields the sound in a very tight area. They have the ability to control the output volume. Mr. <br />Rymarczyk asked if it will be less than 55 at the property line. Mr. Willse said yes, they would meet or exceed the <br />code requirement. Mr. John Dailey, Councilman of Ward 2, came forward to speak. He said the last time they had a <br />restaurant proposed along a residential street was probably the Burger King on the corner of Canterbury and Lorain. <br />He said getting in and out of that parking lot on a much less traveled street is a nightmare. Coming in off of <br />Canterbury is really tough, and it is only a 2-lane street. His biggest concern with the proposed site is cars trying to <br />get in off of Clague Rd. making a left hand tum if heading south on Clague. This will cause a traffic back-up on <br />Clague, even after just reconstructing the intersection. It will cause more of a hardship on the residents. Mr. Bowman <br />and Mr. Sturgeon can probably address that better as they see the traffic pattern every day out their front doors. The <br />other concerns come from the residents of Summerland. The residents he spoke with are opposed to a restaurant that <br />close to their homes. He wants to be sure they are addressing any potential traffic concerns, and liabilities along those <br />lines. Mrs. Hoff-Smith asked if traffic was the only concern of the people on Summerland. Mr. Dailey said residents <br />of Summerland already have a disadvantage in trying to make a left hand tum onto Clague to head south. Turning <br />right is not as big a deal but they may be more concerned about pulling out and making a right and trying to excel <br />toward the intersection with cars there trying to make a turn. Mr. George Bowman came forward and indicated he <br />lives directly across the street from the proposed Wendy's. He said the east side of the CVS is a truck delivery area. <br />Everything delivers on the little road they propose to have as an exit to Lorain Rd. He said secondly, the time <br />Wendy's will be busy is the time their traffic is the busiest. He said there is heavy traffic in the morning going <br />southbound on Clague to I-480. If soineone is stopping at Wendy's in the morning they will be tying up traffic. He <br />sees it everyday. One car trying to make a tum can back up traffic all the way to Lorain Rd. He added that in the <br />evening if someone wants to tum in and pick up dinner, they will have to go across a tum lane and 2 other lanes to get <br />in there. It will not work. He said it also adversely affects property value. That is a huge concern. He said the <br />business belongs on Lorain Rd. and not on a side street. Mrs. Kay Bowman came forward to say a lot of things have <br />been addressed but no one has addressed what the people on the west side of the street are going to have to look at. <br />She indicated if she opens her front drapes she will have to look at Wendy's. She said she understands fliey are <br />getting a variance to be even closer to the street, which puts them closer to her front window. Mr. Allan pointed out <br />they have not been given anything yet. IVIrs. Bowman said there are 2 lanes in front of her house, on her side of the <br />street, and just as you get into the bend is where the road narrows. She said if there are people making a left hand tum <br />off of Lorain, and there is already a problem with people coming out of the gas station and the cleaners, the drivers at <br />that point on Clague are not going to see anybody. She said when she goes to tum in her driveway, she can't swing <br />out to do it because there is a lane of traffic next to her. She asked what it will be like with this new place across the <br />street. Mrs. Mary Jane Smith of Clague Road came forward. She indicated she is directly across the street from the <br />proposed Wendy's. She has great concerns about the traffic. She said they just completed fixing the road in order to <br />alleviate some of the problems on Clague Road and now they want a Wendy's there which will compound the <br />problems the residents experience there. She said that going south there are 2 lanes but it narrows to 1 and everyday, <br />at least 4-5 times a day, she hears screeching brakes. She asked for clarification on the entrance on Clague Rd. She <br />asked if the drive will be an entrance only or exit only. Mrs. O'Rourke indicated they are proposing both entrance and <br />exit. Mrs. Smith mentioned the CVS sign is very bright. She doesn't need a night light. She said they will now be <br />adding more lights and she is not happy. She realizes it is a com'mercial property but something else could be put <br />14
