was removed. Mr. Farrell said an 8 foot fence is not a problem for his client to put up. He added the lights are <br />directed downward. He said a wood fence might be a problem because the Architectural Review Board requested a <br />white vinyl fence for aesthetics and durability. Mrs. O'Rourke asked if the fence is 8 feet from the western corner <br />back. Mr. Farrell conf'irmed that. Mr. Rymarczyk said he does not believe the fence on Dewey is white, and it should <br />all match. Mr. Farrell indicated the fencing will all match. Mr. Farrell said the fence on the mound is 6 feet because <br />the mound is raised. Mr. Rymarczyk indicated it was approved by Council at 6 feet. 1VIrs. O'Rourke said if they make <br />it 8 feet next to Mr. Beebe, will they make it 8 feet behind him as well. Mr. Beebe said he is on the north side. Mr. <br />Farrell clarified that Mrs. O'Rourke is asking about behind his property to the west. Mr. Beebe said there should be a <br />fence there. Mrs. 0'Rourke said there is a fence planned it just is not at 8 feet. Mr. Beebe said that is not necessary. <br />Mr. Robert Heberbrand of Porter Rd. said he wants to review the plans because he did not get a chance to see them. <br />He wants to know what the difference is from the original plan. His understanding is there was not supposed to be a <br />driveway on Dewey. He asked how long the temporary driveway is going to be there. Mr. Koeth said that is <br />something the contractor would have to submit to the city to be able to have the driveway. Typically it is until the <br />construction is finished. Mr. Heberbrand said they have a concrete curb in there as if it's going to be a permanent <br />driveway with a brick wall. Mr. Koeth said the driveway will not stay there. The resident asked if they will have an <br />entrance coming off of Porter. Mr. Koeth said there is a 12 foot driveway now. They have to have it. Mr. <br />Heberbrand said they have trucks and car haulers coming down Dewey and the residents can't get by. Mr. James <br />Maxin of Dewey Rd. addressed the board. He indicated he lives just north of the property. He said any questions or <br />concerns he has had in the past he has addressed with the manager of the dealership and there seems to be some <br />conflicting things that have come up. That is why he is present. He was originally told this project would be <br />completed by mid-November. That won't happen. He said there are pipes that are 7 feet in diameter that are on the <br />property immediately adjacent to his. He asked how long those will be there. He mentioned the fence to go on top of <br />the mound is supposed to be a board on board fence. He understood that to be acceptable but he wants to know how <br />much space is between the boards, especially if there are lighting issues. He asked if the fence will go up prior to the <br />lights being raised to keep the lights away from his property and the neighbors. They have not even seen a mound of <br />dirt that reaches 6 feet all the way around yet, and obviously no fence. He said if the lights will be going up first, how <br />long will they have to wait for a fence to go up. Mr. Koeth suggested that the resident meet with Mr. Farrell, or the <br />architect, or contractor to get those answers. Mr. Maxim asked about bringing in heavy equipment and trucks on <br />Dewey. Mr. Koeth said that will stop until they get the temporary driveway permission from the city. Once the <br />construction is completed, that has to go away. Mr. Bill Jordan of Dewey came forward and indicated he has the first <br />house on the street. He is very concerned about the temporary driveway. He said it is obviously easier to ask for <br />forgiveness than it is to ask for permission. He said the driveway is paved all the way to the sidewalk. It is going to <br />be there unless it is removed and barricaded and construction equipment and heavy equipment goes in either on <br />Lorain or Porter, which are two highways, not a residential street like Dewey. He had photographs and said he would <br />like a photo of the current plans. W. Koeth said the board can supply him with a blueprint. Mr. Koeth said the <br />applicant has to apply to the engineering department for the temporary driveway. Mr. Jordan said the damage has <br />already been done. Mr. O'Malley said it may be a police matter if trucks are on a street where they are not permitted. <br />Mr. Jordan explained it is a very low priority. He has called on every vehicle that is parked on the sidewalk and <br />reports serial numbers but the police do not show up in time. Mr. Farrell indicated he will take this up with Mr. <br />Halleen in the morning. Mr. Bob Trapp of Porter Rd. came forward. He indicated he is the third property north of the <br />site. One of his concerns is the car carriers. He said if, as he hears, they will not be able to use Dewey Rd., he is <br />concerned about them using Porter Rd. He does not see how they can get trucks off of Porter into that area. He asked <br />if Mr. Farrell could speak to the operations of the business. Mr. Farrell said if anyone has concerns he will meet with <br />them in the hallway, give them business cards, and residents can call him tomorrow to find out how it will be <br />addressed. Mr. Koeth said the majority of car carriers will come in off of Lorain Rd. when the construction is <br />completed. Mr. Trapp indicated he is concerned about the day-to-day operations of the business and not the <br />construction period which is an upset in the normal conditions. Mr. Rymarczyk said the only drive is from Lorain Rd. <br />when the project is finished. It is the only access to the property. 1VIr. Trapp asked if customers would be able to go <br />in off of Porter. Mr. Rymarczyk said they could not, not according to the plans they have currently. W. Trapp asked <br />how that will be enforced. Mr. Rymarczyk said hopefully they will put up the grass strip and some landscaping. Mr. <br />Trapp indicated that is why he is asking for someone to speak to the operations of the business because it is fine to say <br />right now there will be no car carriers or customers coming in off of Porter, but they don't know what will actually <br />happen. Mr. Farrell said there will be access from Porter. Mr. Ryrnarczyk said they are not showing it on the plan. <br />Mr. Trapp asked if the owner or operator of the business can state to him, as a resident of that street, that there will <br />never be any vehicle carriers accessing the property off of Porter.
