business is open on Sunday. Mr. Farrell indicated it is not. Mr. Trapp pointed out that this past Sunday at <br />approximately 10:30 or 11:00 am there was a car carrier on the property unloading vehicles. There was no one there <br />from the business to receive the vehicles yet they were being unloaded. He is saying the residents need some <br />assurance in writing that will be enforced that there are particular business hours that carriers will be in there. It does <br />not include Sundays, 2:00 in the morning or any other time outside of normal business hours. He would like the <br />owner to state these things in writing so that if something does happen he can go to the police or city council and say <br />the owner is violating lus trust. He finds it curious that the building just kind of disappeared. He says that because, as <br />he understands what has happened with this property and as he has seen it develop, all of the storm water on the <br />property has to be self-contained. He asked the city engineer if that understanding is correct. Mr. Deichmann <br />indicated that is correct. Mr. Trapp said part of the reason for having the inlets, the catch basin, and the huge pipes <br />underground is only for that purpose; to maintain the storm water for a certain period of time and not discharge it into <br />the general storm sewer system. He said there was an original plan that included a building that is no longer there. At <br />the time that plan was made someone had to know then that the building was not going to be there. He said if you <br />look at the sidewalk on Porter and the surrounding area, that would all have had to be re-graded to create a large basin <br />there. If that building were to stay there, the floor of that building is 24-30 inches above the grade of the sidewalk so <br />he doesn't see how an original plan could have been made with the building being there and grading the property the <br />way it should be graded to contain the storm water. He is suggesting the disappearance of the building did not just <br />happen after the fact. It was planned all along because right now the pavement is 2-3 feet below the surrounding <br />grade to create that basin. He said the whole area had been planned out knowing that the building wasn't going to be <br />there. He doesn't care if the building is there or not. His neighbor does because it used to block out the light. He is <br />suggesting that perhaps there is a little bit of disingenuous talk about what was planned for the sight, which only leads <br />him to be a little bit concerned about what will happen to the site once it is completed and in operation. He wants <br />some assurances as an immediate neighbor of that property. He walked around the Halleen property and has looked <br />for a building permit. They are renovating the building that fronts on Lorain and he has not seen anything posted. He <br />is concerned about the entire operation. He would recommend that either the Planning Commission or Council gets in <br />writing from the owner certain rules and regulations that will be adhered to with the understanding that if they are not <br />adhered to that the residents of the area have full access to Council or law enforcement to make sure those things are <br />carried out. Mr. Rymarczyk indicated there was a permit pulled for the project. It may be posted inside to keep it out <br />of the elements. Mr. Trapp asked if it is supposed to be visible to someone passing by. Mr. Rymarczyk indicated not <br />necessarily but there should be one on the job site. Mr. Spalding asked engineering about the additional paved <br />parking that was not there before. He wondered if it will impact the amount of storm water drainage that the owner is <br />going to require. Mr. Deichmann replied they will look at that. They will double check the area that the applicant <br />used in the calculations. Mr. Rymarczyk said he believes it is the same area that the building occupies so he does not <br />believe the applicant has to come back for that. Mr. Deichmann said as long as they are not paving over area that <br />would have been landscaped, and it is simply replacing a building with parking, it is not an issue. Mr. Ken Felleisen <br />of Porter Rd. addressed the board. He said he really appreciates the idea of green space along Porter to reduce the <br />driveway so those carriers will not be out there all the time. He indicated when Giant Eagle went tlu-ough the <br />approval process, it was said that Porter Rd. was not a truck route. He said trucks do go up and down the street and <br />the residents want to reduce that traffic. He said the way the driveway was all across where the building once stood, <br />up to the store at the corner, the snow removal was across the sidewalks. He said the green space may reduce that. <br />Mr. Koeth asked that Mr. Halleen's son convey the message to his father, the owner of the property, so he is aware of <br />the concerns of the residents. Mr. Farrell indicated he will relay the message to his client. <br />R. Koeth made a motion to table the proposal with the following recommendations: Halleen Kia will have the <br />contractor contact the engineering department to be able to access that temporary road onto Dewey and to cease and <br />desist as far as any more trucks there. The residents will be watching to see if that does happen. They should keep <br />the trucks on Lorain Rd. They should come in with a lot consolidation showing the easement. The entrance way into <br />Porter Rd. should be landscaped with green space up to the point to where there is the 12 foot driveway. The board <br />requests landscaping around the sign there as well. They would like to have the fence match the fence that is along <br />Dewey Rd. but they would like it 8 feet high by the L-shape portion of the lot. Mr. Koeth reiterated what Mr. Trapp <br />said as far as consideration of the trucks coming in onto Lorain instead of Porter Rd. They want the photometric plan. <br />If there will be any other types of changes, the contractor will contact the engineering department before anything is <br />started. Mr. Rymarczyk added they will need a new set of drawings the Thursday prior to the next Planning <br />Commission meeting. The motion was seconded by W. Spalding and unanimously approved.
