Mr. <br />Koeth pointed out that the public will not participate in discussions at the next meeting. They <br />are there to observe. Mr. Koeth brought up the Earl Scheib building that has changed hands. It <br />went through the minor change process and he asked if Mr. Rymarczyk can provide.the board <br />with information on when that took place: He explained that when there are minor changes on a <br />proposal, the building department sends information to the chairman of the Architectural <br />Review Board, the Board of Zoning and Development, and Planning Commission. The <br />chairman have 10 days to look over the minor changes and determine whether it is a minor <br />change and ok to go through, or it is something the boards should review. There. is an <br />opportunity to object. Mr. Spalding asked what determines a minor change. Mr. Rymarczyk <br />indicated it is the interpretation of the building commissioner, providing there are no variances <br />required. If a variance is needed, it cannot go for a minor change. There was further discussion <br />about the process for handling a minor change. <br />Mr. O'Malley pointed out that he and Mr. Dubelko were discussing a matter earlier that they <br />thought was appropriate to bring to the attention of the Planning Commission. Some time ago, <br />the Planning Commission took up the matter of a rezoning issue on the far west end of town <br />involving the soccer complex. He said he believes the matter proceeded before Council but <br />there was no recommendation from the Board of Zoning and Development to take up the <br />recommendation that Planning Commission made to expand the scope of the rezoning beyond <br />the soccer complex and down Lorain Road. Mr. O'Malley added that matters that come out of <br />Planning Commission go directly to the Council committee and then that committee would then <br />request legislation. He does not want the Planning Commission to draw the inference that <br />perhaps the Council committee did not appreciate the lengths to which the Planning <br />Commission studied this matter. It was Mr. Dubelko's suggestion that the Planning <br />Commission be advised of the fact that its recommendation did not obtain a sponsor for <br />legislation. It was not moved on through the committee and perhaps it is a matter that can be <br />addressed in a memo more directly. W. Koeth asked if the soccer complex was approved. Mr. <br />O'Malley said he believes that part of the rezoning did proceed. He said it was the scope of the <br />rezoning beyond the soccer complex that did not move on. 1VIr. Koeth said that perhaps t ey <br />can take a look at it again. He feels it will help the City and they are taking a step forward. It <br />hasn't been rezoned in over 50 years and to be able to do something like that is the smart thing <br />to do. He said they would like to come up with a letter. The board discussed the boundaries for <br />the rezoning that they originally established. Mr. O'Malley said the point is to make sure the <br />Planning Commission's recommendatiori did not result in legislation being requested, and it is <br />not necessarily a reflection of Counci]'s unwillingness to examine it. It is possible it got lost in <br />the extensive minutes. Mr. Lasko commented they had been concerned about having to deal <br />with all these matters on a parcel by parcel, case by case basis. As a result they made the <br />recommendation that the whole area, with the constraints they recommended, be approved. He <br />asked if the board is still stuck in effect with a parcel by parcel, case by case basis. Mr. <br />O'Malley confirmed that. He said the first parcel went through and the balance of the area is yet <br />to be addressed. The Planning Commission can tackle any rezoning anywhere in the City at any <br />time within the confines and the guidance of the master plan and make recommendations <br />regularly and then it depends on the Council to pick it up and run with it. Mr. Hreha suggested <br />they go ahead and write a memo indicating that the matter was brought to their attention that <br />nothing was done on it and they can ask for an explanation as to why. Mr. Koeth agreed and <br />said they would like to know the reason why it was not approved yet. Mr. O'Malley indicated <br />they can specifically request a reason why their recommendation was not acted upon. Mrs. <br />O'Rourke asked to whom the memo would be directed. Mr. O'Malley said they could consider <br />sending it to the Mayor. It was suggested they send the memo to the members of the Board of <br />Zoning and Development and copy the Mayor. <br />7
